AN ORDINANCE LEVYING THE 2009 SPECIAL ASSESSMENT
ANNUAL INSTALLMENT AND APPROVING THE 2009 SPECIAL
ASSESSMENT ANNUAL INSTALLMENT ROLL FOR THE
BRIARCLIFF PROFESSIONAL PLAZA NEIGHBORHOOD
IMPROVEMENT DISTRICT.
WHEREAS, the City, after filing of a proper petition (the "Petition") with the City Clerk
on April 1, 2008, pursuant to the Neighborhood Improvement District Act (the "Acf~, Sections
67.453 through 67.475, inclusive, RSMo, as amended, and in compliance with all requirements of
the Act, created the Briarcliff Professional Plaza Neighborhood Improvement District (the
"District") within the City to acquire, constmct and improve certain public landscaping, entrance
and street improvements (the "Improvements"), with the fmal cost of the Improvements to be
assessed against the benefited property as set forth in the Petition;
WHEREAS, the City has (i) found and determined that the Improvements have been
completed, (ii) established the final costs to be assessed against the benefited properties within the
District; (iii) found that benefits of the Improvements exceeded such costs; and (iv) made such
other findings as were required under the Act;
WHEREAS, the City, pursuant to Ordinance 2009-88 adopted August 4, 2009, assessed the
final costs as special assessments against the benefitted properties within the District (the "Special
Assessments");
WHEREAS, the City provided to the property owners within the District notice (i) of the
Special Assessments, (ii) that the Special Assessments could be paid in full until August 26, 2009,
and (iii) that any Special Assessment not paid in full by such date would be payable in
substantially equal installments over twenty years at five percent interest per annum ("Annual
Instalhnent'~;
WHEREAS, only one property owner, Riverside Medical Complex, LLC, paid its Special
Assessment in full; and
WHEREAS, the Annual Installment for the remainder of the Special Assessments are to
be levied for the current calendar year and the related Special Assessment Annual Installment
Roll approved.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS:
Section 1. The Boazd hereby confirms the levy of the Special Assessments and hereby
levies the annual installment of the Special Assessments together with interest at the rate of five
percent per annum against the properties within the District as set forth on the Special
Assessment Annual Installment Roll attached hereto as Exhibit A ("Roll") and approves the Roll
for the calendar year 2009.
Section 2. The Finance Officer is hereby authorized and directed to file the executed
Special Assessment Annual Installment Roll with the Platte County Collector's Office.
Section 3. The City shall, and the officers and agents of the City aze hereby
authorized and duetted to, take such further action, and execute such other documents,
certificates and instruments as may be necessary or desirable to carry out and comply with the
intent of this Ordinance.
Section 4. This Ordinance shall be effective immediately upon adoption by the Board
of Aldermen.

2009 SPECLAL ASSESSMENT ANNUAL INSTALLMENT ROLL

To Donna C. Nash, Collector of Revenue of Platte County, Missouri:
This is to certify that by virtue and authority of the provisions of Sections 67.453 to 67.475, RSMo, as
amended, the Board of Aldermen of the City of Riverside, Missouri has levied the sum of $ 11,941.75 as
the annual installment of the special assessments for the year 2009 on the real estate and other property
situate in the Briarcliff Professional Plaza Neighborhood Improvement District, City of Riverside, Platte
County, Missouri, as set out in the following table, in which aze: First, the names of the present owners
of said lands and other property so far as now known; second, the tax parcel number of said lands and
other property opposite the names of said owners; and third, the amount of said annual installment of
special assessment levied on each tract of real estate and other property. The said annual installment of
special assessments shall be collectible and payable the present year at the same time that State and
County taxes are due and collected, and you are directed and ordered, pursuant to Section 67.463, RSMo,
as amended, to demand and collect the said annual installment of special assessments at the same time
you demand and collect the State and County taxes due on the same lands and other property, and this
"Special Assessment Annual Installment Roll" shall be your warrant and authority for making such
demand and collection.
