HomeMy WebLinkAbout2006-12-01 TIF Commission ResolutionResolution No. 2006-12-01 A RESOLUTION APPROVING THE SECOND AMENDMENT TO THE GATEWAY REDEVELOPMENT PLAN, AS AMENDED; REDUCING THE REDEVELOPMENT AREA THEREUNDER AND APPROVING ACTIONS RELATED THERETO AND EXPRESSING TIIE RECOMMENDATION OF SAME TO TIIE CITY OF RIVERSIDE, MISSOURI. WHEREAS, the Tax Tncrement Financing Commission of Riverside, Missouri ("Commission") was created pursuant to Ordinance No. 95-64, adopted by the Board of Aldermen of Riverside, Missouri (the "Board of Aldermen") on September 12, 1995; WHEREAS, the Real Property Tax Increment Allocation Redevelopment Act, Sections 99.800 to 99.865 of the Revised Statutes of Missouri, as amended (the "Act"), requires the Commission to: (a) hold hearings with respect to proposed redevelopment areas, redevelopment plans, redevelopment projects and amendments to same; (b) vote on the approval of the same; and (c) make its recommendations on the same to the Board of Aldermen; WHEREAS, the City, pursuant to Ordinance No. 2001-108, enacted on October 2, 2001, adopted and approved the Gateway Redevelopment Plan (this plan, as amended, the "Plan") in order to facilitate the improvement, revitalization and remediation of blighting conditions on properties located within the Gateway Redevelopment Area (the "Redevelopment Area"); WHEREAS, amendments to Che Plan are proposed including the reduction of the redevelopment area under the Plan and amendments relating thereto. NOW, THEREFORE, BE IT RESOLVED BY THE TAX INCREMENT FINANCING COMMISSION OF THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS: Section 1. All actions taken for and on behalf of the Commission in connection with the Plan and the Second Amendment including but not limited to selecting a date for the public hearing, the providing of notice to the taxing jurisdictions and to the property owners and the publication of notice and all other actions related thereto are hereby approved, ratified and confirmed as acts of the Commission. Section 2. The Second Amendment to the Gateway Redevelopment Plan, attached hereto as Exhibit A, is approved. Section 3. The Redevelopment Area under the Plan is reduced to the area set forth in Exhibit A. Section 4. The Commission recommends to the City and its Board of Aldermen that the Board of Aldermen pass one or more ordinance approving the Second Amendment. Section 5. This Resolution shall be in full force and effect from and after its passage and approval. PASSED BY THE TAX INCREMENT FINANCING CON1M $ION OF THE CITY OF RIVERSIDE, MISSOURI, THIS 13~h DAY i ECEMBER 20 ;' ,~ ~, ~~ se l] ~-~ ~~-"" on Super, ha~n n ~~~-~ Pamela Dara~, Secretary SECOND AMENllMENT TO THE GATEWAY REDEVELOPMENT PLAN WHEREAS, the Board of Aldermen of the City of Riverside, Missouri (the "City") established the Tax Increment Financing Commission of Riverside, Missouri (the "Commission") pursuant to the TIF Act; and WHEREAS, the Commission considered a redevelopment plan entitled "Gateway Redevelopment Plan" (the "Original Plan") and the designation of a redevelopment area described in the Original Plan (the "Redevelopment Area"); and WHEREAS, pursuant to Resolution No. 01-01, the Commission, after giving all notices required by the TIF Act and holding a public hearing at which all interested parties had an opportunity to be heard and at which the Commission heard and considered all protests and objections concerning the Original Plan and the Redevelopment Area, voted to recommend to the City that the Original Plan be approved and the Redevelopment Area be designated a "redevelopment area"; and WHEREAS, after due consideration of the Commission's recommendation and after making each of the findings required by Section 99.810 of the TIF Act, the City adopted Ordinance No. 2001-108 designating the Redevelopment Area as a "redevelopment area" and approving the Original Plan; and WHEREAS, the Original Plan was amended, pursuant to the TII~ Act, by the First Amendment to Gateway Redevelopment Plan (the Original Plan, as amended, the "Plan"); and WHEREAS, the Redevelopment Area now consists of approximately 300 acres, located generally along Vivion Road east and Gateway north of the intersection of Vivion Road and Gateway, all in the City; and WHEREAS, pursuant to this Second Amendment, the Redevelopment Area is being reduced by a little over twenty acres to approximately 280 acres. PLAN AMENDMENTS NOW THEREFORE, the Plan is amended as follows: 1. The legal description of the Redevelopment Area is amended to the legal description set forth on Exhibit SA-B. 2. All references to the size of the Redevelopment Area are amended to read as approximately 280 acres. 3. All references to tax parcel cumbers 19-8.0-33-300-001-003-000, 19-8.0-33-300- 001-003-001, 19-8.0-33-300-001-003-002, 19-8.0-33-300-001-003-003,19-8.0-33-300-001-004- 000, 19-8.0-33-300-001-001-000,19-8.0-33-300-001-001-001,19-8.0-33-300-001-001-002 and 19-8.0-33-300-001-002-000 are deleted from the Plan.
