HomeMy WebLinkAbout2002-07-15 Board of Zoning Adjustment Minutesa Minutes of Meeting of Board of Zoning Adjustment July 15, 2002 The Board of Zoning Adjustment met in the Riverside City Hall, 2950 DIW Vivion Road, Riverside, Missouri at 7:00 p.m., July 15, 2002. The following members were present: Chairperson Betty Johnson, Bob Krick, Vivian Smith and Jerry Hackenberg. Also present were David Blackburn, City Administrator, Louise Rusick, City Clerk, John Jackson, City Engineer and Matt Kitzi, City Attorneys office. Public Hearing Opened Chairperson Johnson opened the public hearing to consider the request for a variance for a one (1) foot property line set back at 4357 NW Gateway as the proposed building encroaches into the 10' required side yard setback. Brian Ruoff, Warman Design Group Architects, represented David Ramsey and M.M. Hill, Owners of Maser Tech Automotive & Repair and Ramsey Motors. Matt Kitzi explained the requirements in relation to the city code and that the applicant was requesting anon-use variance as outlined in Mr. Kitzi's report (see attached). Mr. Ruoff spoke on the layout of the site. He said the two property owners wish to stay in the area. The building that sits adjacent to this site sits on the property line. The business owners are being relocated because of the levee construction. Mr. Hackenberg asked, "Will the existing building be torn down?" Mr. Ruoff, said "yes". Mr. Krick asked about the south and north elevations and if the front portion would have used cars and trucks. Mr. Ruoff said the variance is on the north side only. Mr. Ramsey said they would limit their number of cars. Mr. Ruoff said there would be an office in the front and the rest of the building would be Master Tech. Ms. Smith asked if Planning and Zoning had approved the plan. It was stated that only the Special Use Permit was approved, and that no building permit application is being presented now, as they (owners and architect) wanted to see where they stood on this matter before they started building plans. Ms. Smith asked if the advertisement had been done, the City Clerk said "yes". She asked if property owners had been notified and the City Clerk said this was not necessary according to the city code. Chairperson Johnson asked, "Where does the property line go back too?" Mr. Ruoff said he would have to double check, he wasn't sure. . ~» Mr. Smith asked, "Could the size of the building be reduced?" Mr. Ruoff said it had been reduced once already and cannot be reduced again in order to accommodate the cars and toolboxes. Mr. Ruoff explained the pattern and size of the building. Everything would be inside. There aze not going to be rows of garage doors. The cars will come in one door in the front and exit out the back like lazge dealerships. It was stated the cars in transit in the back aze to be worked on. There is one access on the south side only. Chairperson Johnson asked if this complies with the fire codes, and it was stated "yes". The wall on the property line is a one (1) hour fire sepazator wall. Nothing flammable is on the outside. Chairperson Johnson asked, "Are there going to be any cars parked on the south side and will fire trucks be able to get through?" Mr. Ramsey said, "No cars will be parked there, this is just an access to the rear." Mr. Kitzi asked John Jackson (i) whether he had reviewed the plans; (ii) was he familiar with the permitted uses; (iii) is this a permitted or special use; and (iv) was the required side footage 10'? He said, "yes" to all questions. John said the business owners could not have the full 10' set back on both sides, and that a variance would be necessary for any commercial use on the particulaz lot. Mr. Jackson also stated that this particulaz lot is so unique in size and shape as to make a variance necessary. Finally, Mr. Jackson stated that other buildings and uses in the vicinity have similar variances, non-conforming use chazacteristics or other similar building styles and therefore granting the variance would not interfere with or offend the general land use plan for the neighborhood. Public Hearing Closed Chairperson Johnson closed the Public Hearing at 7:25 p.m. Motion to Approve Variance Bob Krick made a motion to accept the requested variance to allow a (1) foot property line set back, seconded by Jerry Hackenberg. The vote was: Bob Krick, Vivian Smith, Betty Johnson and Jerry Hackenberg in favor of the Motion. Motion can•ied. Adjournment Jerry Hackenberg made a motion to adjourn 7:28 p.m., sec d by Bob Krick.
