MINUTES OF BOARD OF ZONING ADJUSTMENT SEPTEMBER 12, 1995 the Boar^d of Zoning Adjustment met in the City Hall in Riverside, Missouri on September 12, 1995, at 6:00 p. m. These present wer^e Bill Bright, John Marshall, Richard Grogan and Mayor Betty Burch. Bill Bright was acting chairman in the absence of the Chairman Janet Heating and announced that a Chairman would have to be elected because of Janet I:eating moving out of the Gity. John Marshall nominated Bill Br-fight as Chairman of the BZA, Richard Grogan seconded the nomination. Betty Burch moved that the nomination cease, seconded by Richard brogan, a vote was called for, all present voted in favor. Acting Chairman Bill Bright called for^ a vote on John Marshall's nomination of Bill Bright as Chairman of the BZA, all voted in favor, motion carried. Monty Peterson, 6629 N. Mercer, with AR•B Taw Service said that he has been the custodian far the City's vehicles which are towed and stored behind Car-Brit e. He said he has purchased the property between Industrial Springs and where Structo Fence used to be. The frontage of this lot is B0 feet and the length is 300 feet. He would like to move the t~~w lot to this place and request that it not be black- t~~+pped and that the he be able to build on this lot which is less than required by Ordinance from 100 feet to B0 feet. This matter was discussed. Richar^d brogan moved that the BZA deny the variance from 100-foot width to 80-foot width, seconded by John Marshall, the vote was John Marshall, yes, Dick Grogan, yes, Betty Burch, yes and Bill Bright, yes. Jahn Marshall moved to deny the request of not black- t~-+pping the lot, seconded by Dick brogan, the vote was Jahn Marshall, yes, Dick Grogan, yes; Bill Bright, yes; and Betty Burch, yes. An application was received from Nancy Bascom Howe, Box 21, Royalton, VT 05068 and repr^esented by Janet Hays, of J. D. Reece Realty Company, to waive a requirement to survey land before sale of property <4305-4307 NW 52nd Streetl to Steve and Mildred Baskan, because they want to subdivide the proper^ty and build another house on the property. It was felt that this request was premature and inappropriate. Because of the lateness of time, John Marshall moved that the BZA meeting recess until 7:00 p. m. September 18, 1995, seconded by Richard Grogan the vote was Jahn Marshall, yes; Richard Grogan, yes; Bill Bright, yes; and Betty Burch, yes. The BZA meeting reconvene on September iB, 1995 at 7:00 p. m. Those present were Richar^d Grogan, John Marshall, Betty B~_irch arrd Chairman Bill Bright. Steve Walcott, Attorney, r^epresenting Rrgasy Gaming Cc>mpany spoke to the BZA members and said that dust in case these applications were tur^ned dawn by the BZA, he would need this information tG use at ether hearings and he has r^equested that a court reporter be present to record the meeting. Mr^. Wolcott then presented tG the BZA members a summary of variances requested by Argosy Gaming Company. Mr. Wolcott started with the ninety-five foot high sign variance, next the copy area, which is larger than set out in Gr^d finance, next the change in copy area <is this considered animated), next part of the sign would be flashing, which is not allowed in City Ordinance, next double sided sign, next three separ^ate copy areas (where Gnly one is allowed). A discussion was had concerning these requested variances. It was the consensus of the BZA members that the best way tG handle these variances would be far Argosy Gaming Company to r^equest changes in the sign ordinance. Mr. Wolcott requested permission to withdraw the Argosy Gaming CGmpany Applications from the Board of ZGning Adjustment for variances in the sign Grdinance. Dick Grogan moved to accept the withdrawal by Steve Wolcott of his applications for var^iances which were filed with the Board of Zoning Adjustment, seconded by John Marshall, all voted in favor, motion carried. The Beard of Zoning Rd~ustment discussed procedures to be followed by the BZA. The Applicant asking for a variance from the Ordinance through the BZA has to prove all of the items set forth in the ordinance, if the variance is to be approved. ...
