HomeMy WebLinkAbout1990-11-20 Board of Zoning Adjustment Minutes BOARD OF ZONING ADJUSTMENT TUESDAY, NOVEMBER 20, 1990 7:01 PM Chairman Janet Beating called meeting to order. Those present were Gary Brenner, Janet Beating, Jim Wedua, John Marshall and Ed Rule. Bill Connely, 4415 N.W. Pawnee, is requesting a variance Por a privacy Pence in his back yard from 6' to 8' feet in height, or a 2' variance. The fence will run 109' and 83' will be at 8' and the remainder at the required 6'. The reason given was the terrain of the yard prevented the 6' requirement prevented any privacy in sections of the yard. John Marshall moved the variance be approved because of the unique character oP the property. Gary Brenner seconded. John Marshall, Gary Brenner, Janet Beating, Ed Rule and Jim Wedua-all voting yes. Motion to grant variance passed. Mr. Sam Carter and Mr. Leary Skinner, Attorney, representing Carter Petroleum Products, Inc., to be located at Platte Valley Industrial Park, came before the board requesting a variance to permit above ground storage oP gasoline and diesel fuel. Mr. Rule asked how many tanks were involved, their capacity, and diameter. Mr. Carter said t~°~ were 7 tanks and 7 products with the seven tanks having a total capacity of 95,000 gallons. The tallest tank would be 20' and the tanks range in diameter from 10' to 12'. Mr. Brenner asked what type of screening was planned Por the area. Mr. Carter said large trees would be planted on three sides and that the tanks would be painted to hatch the color of the proposed building which is to be a beige color. The City attorney asked if federal law pertains to these tanks. Mr. Carter said the guidelines and engineering meet or exceed all requirements and that the Division of Weights and Measures had examined the site and containment area and had given Mr. Carter additional recommendations. Mr. Rule asked what the main reason for the variance was as opposed to setting the tanks underground. Mr. Skinner explained it was for environmental reasons and that having tanks underground in the flood plain area and with the high water table there, was not a good idea. Mr. Rule said it was his understanding that origionally there would be no storage of Puel at the site. Mr. Skinner said that Mr. Carter had decided to move the entire operation from Liberty to Riverside and that the business had experienced Board Of Zoning Adj. Page 2 Nov. 20 rapid growth over the past several years and the addition of the storage tanks was necessary. Mr. Brenner said he had visually inspected the area from 9 Highway and I-635 and thought the appearance of the tanks would be minimal. Mr. John Brown added that plans call for additional buildings to be build to the east, which would virtually block the visibility of the tanks from most vantage points. A discussion was held on various aspects of underground storage of fuel tanks and above ground esthetics. Mr. Brenner was concerned where the "check guard" was as far as who keeps track of every agency involved upon completion. Mr. Skinner said when the occupancy permit is issued-all requirements and agency approvals will be delivered at that time. The City attorney said in the zoning code under other allowable fuel-type circumstance are allowed that the city required: 1. A special use permit 2. Proper screening 3. Adequate upkeep of the facility Gary Brenner made a motion to grant the variance because of environmental concerns, in the condition that the proposed facility will be designed to exceed (1) B.P.A., (2) Missouri D.N.R., and Missouri Department of Agricultural Division of Weights and Measures specifications Por safety and protection of the environment. It will exceed <3) N.F.P.A #30 and #30A regulations for the safety protection and will meet or exceed recommendations of the (4) Western Chiefs Fire Association for above ground storage tanks. A (5) special use permit must be obtained and (6) proper screening must be provided and (7) applicant shall maintain adequate upkeep on the storage containers and planned screening. John Marshall seconded. Votes were unanimously in favor. Motion to grant variance to allow above ground storage tanks passed. Brenner moved to adjourn meeting, motion seconded. 7:45pm Gar Brenner Se retard'
