Board me~bers present were: Janet Keating, Gary Brenner,
Floyd Best and Jim Wedua.
Mr. Sam Aylett explained to the board on behalf of Jim Davis,
developer, 2404 Osage Court, to discuss a revised preliminary
plan for the Indian Hills Estates regarding a variance needed
from 10~ to 12X on the grade for streets in two locations.
One on Indian Lane for 450 feet and one on Apache for 350
feet.
A Mr. Kulhman from the audience asked where any fill might
come Prom and about extending a street onto St. Joe Blvd.
Mr. Aylett pointed to areas on the plan where fill would come
from and explained developing St. Joe Blvd. was cost
prohibitive at this time.
Mr. Keating, from the audience, asked the size of the area of
a proposed park shown on the plan. It appeared to be about 3
and one-half acres.
Gary Storm, city engineer, asked if a design speed had been
drawn. Mr. Aylett presented a design speed chart.
Mr. Rule clarified that this board was only concerned on
voting on the variance of the slope of the roads and that
other concerns would be handled by those involved.
Mr. Kulhman asked if this variance would set a standard for
future developments in the city. Mr. Best and Mrs. Keating
said it would not, that all variances are considered on their
own merit.
Mr. Witt, city attorney, said the board could consider two
issues. One being the slope variance and the other a
amendment regarding protection of existing trees.
Mr. Frank Martin, from the audience, asked how many acres
were affected by this project.
Mr. Kuhlman asked if the city maintenance people or public
safety had objections to this plan. It was explained that a
letter had been sent regarding the previous plan but not for
this revised plan.
Mr. Rule made a motion to grant a variance from 10~ to 12~
for 450 feet on Indian Lane and 350 feet on Apache,
due to the unique character of the land. seconded by Jim
Wedua.
Janet Keating amended the motion to include that the

the developer file a plat showing the location of existing
trees that are to be retained which shall be approved by the
planning commission of the final plat. The trees to be
retained on the plat may not be removed without the
permission of the zoning enforcement officer. Best seconded
and the votes were as follows: Wedua, Rule, Brenner voting
no. Keating, Best voting yes. Motion failed..
The voting on Mr. Rule's motion were as follows: Unanimously
in favor. Motion to grant variance passed.

Mr. Witt pointed out the reason for the 35' height
restriction is for fire protection and it was pointed out by
the board that if these petroleum tanks were to catch fire
that it would be too intense for Riverside to fight with
their one truck.
The reason for the domes are to improve air quality and to
reduce hazardous waste, and would result in substantial
justice for all.
Gary Brenner made a motion to grant a variance on two storage
tanks to a maximum of 65'. Floyd Best seconded. Voting was
unanimous in favor. Motion passed.
Brenner moved to adjourn the meeting, Best seconded.
