Those present were: Floyd Best, John Marshall, Jim Wedus, Ed Rule and Janet Keating. Chris Sayers (sic) presented a application for Dr. Noyes. A variance is requested for a driveway-parking lot on a set- back of 25' to a requested 12'. Floyd Best requested Mr. Fletcher look at the plan also for access by firetrucks. Keating polled the zoning board and it was thought the firetruek would have no problems. Floyd Best made a motion to grant the variance. John Marshall, Jim Wedua, Bd Rule and Janet Keating voting yes. Motion to grant variance passed. karx~y Hdg~r, ~7~~ N.W. Floyd Best moved we give the variance since the shed was built without knowledge of zoning members. 8d Rule seconded. John Marshall, Jim Wedua, Janet Keating, Floyd Best and Bd Rule voting yes. Motion to grant variance passed. Janet Keating, acting secretary. Board of Zoning Adjustment Page 2 June 5, 1990 The correct procedure to follow in adopting this amendment would be the following: 1. Both Janet Keating and Gary Brenner will need to sign the original amendment which is being sent to Ms. Keating; 2. At the next Board of Zoning Adjustment meeting, there will need to be a vote on the amendment to the minutes of the May 8, 1990 meeting after all board members have had an opportunity to thoroughly review the amendment; 3. If the amendment passes, the minutes of your meeting should make reference to the discussion, vote and state that "the attached document regarding the amendment to the Board of Zoning Adjustment's Wednesday, May 8, 1990 meeting is incorporated by reference as though more fully set forth herein." The minutes, as written, could possibly be construed as allowing Mr. Peak a variance over the entire building and allowing him the privilege of never having to install smoke and heat vents within the building in the future. Some occupancies, for example a group H occupancy, requires heat and smoke vents regardless of the size of the building. Therefore, we have amended the language of the minutes to clarify the fact that this variance is granted only for tenants who fall within a certain occupancy. As you can see by the enclosed document, Mr. Peak has agreed to the amendment. AMENDMENT TO BOARD OF ZONING ADJUSTMENT'S The following language will clarify and supplement the minutes of the Board of Zoning Adjustment's Wednesday, May 8, 1990 meeting in reference to the decision made regarding the variance requested by Dan Peak of ELCA Enterprises, Inc., for a building located at 900 Platte Valley Drive: "The variance granted on each half of the building located at 900 Platte Valley Drive which exempts the owner/occupant from installing smoke and heat vents complying with Section 3206 of the Uniform Building Code will only be.applicable to present and future tenants who fall under the category of Single-Story Group B, Division II and IV Occupancies."
