HomeMy WebLinkAbout1989-05-16 Board of Zoning Adjustment Minutes,` BOARD OF ZONING ADJUSTMENT MAY 16, 1989 4:00 pm. A special meeting of the Board of Zoning Adjustment was called by chairman Janet Keating. Members who were present were Gary Brenner, Bob Scudder, Floyd Best and Jim Wedua. The board is being asked to consider a request from Mr. David Lautenschiager, DBA Life Style Homes, 2 Victory Drive, Liberty, Missouri The request is for a 5 foot variance on the north aide of his proposed project just south of the Eagle Animal Hospital on N.W. Gateway. It is to be a dental lab. The proper application and letter from the adjoining property owner, Dr. Noyes, seemed to be in order. A discussion was had with each board member expressing their view on the interpretation of different points of the variance such as; the width of the Isle. The plans call for 22 feet and Mr. Lautenschiager said he was told 22 feet was required although this number could not be confirmed in the zoning book. Because the board could not determine that this was not o.k., this was it was assumed to be in order. Another point was made that this was the minimum building size that would be considered adequate for this space and use Gary Brenner made a motion that the variance be granted (10 ft from building to property line) instead of 15' as required. Floyd Best seconded and vote was all in favor. Other concerns by the members were as follows; Bob Scudder questioned the size of the area for the septic system, but Mr. Lautenschlager had a letter from the county with their approval.- There was a question by Janet Keating whether or not this application had the right zoning. ~w„~e• 4swt~n~ was tlectrci Chairman q C,Ary b~~nner as SeCrr~~:! Respe tfull Submitted, Gary DAvid renner .y • /,/• 3 (2) That the plight of the owner is due to unique circumstances and not to the general conditions in the neighborhood which may reflect the unreasonableness of the zoning ordinance itself; and (3) That the use to be authorized by the variance will not offer the essential character of the locality, and (4) Imposition of such a hardship is not necessary for the preservation of the plans; and (5) Granting the variance will result in substantial justice to all.
