AN ORDINANCE AUTHORIZING AND APPROVING THE CITY OF RIVERSIDE, MISSOURI,
TO ENTER INTO THE AMENDMENT TO THE INTERGOVERNMENTAL COOPERATION
AGREEMENT BETWEEN THE CITY OF RIVERSIDE, MISSOURI AND SOUTHERN PLATTE
FIRE PROTECTION DISTRICT
WHEREAS, the City and the District entered into that certain Intergovernmental
Cooperation Agreement Between the City of Riverside, Missouri and Southern Platte Fire
Protection District dated May 1, 2008 whereby the parties agreed to provide assistance to each
other according to the terms therein ("Agreement").
WHEREAS, the City and the District have agreed to extend the terms of the Agreement
for one year from the termination date of December 31, 2009 until December 31, 2010.
WHEREAS the City and the District have drafted a Amendment to the Agreement setting
forth the terms of the agreement;
NOW THEREFORE BE TT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF RIVERSIDE, MISSOURI AS FOLLOWS:
Section 1. This Ordinance is intended and is hereby determined and declared to be
necessary to accomplish and serve the public purpose of enhancing the fire protection services
available to the residents of the City.
Section 2. The City of Riverside shall enter into an Amendment to the Intergovernmental
Cooperation Agreement Between the City of Riverside, Missouri and Southern Platte Fire
Protection District.
Section 3. The execution and delivery of the Amendment to the Intergovernmental
Cooperation Agreement Between the City of Riverside, Missouri and Southern Platte Fire
Protection District, in substantially the form attached hereto as Exhibit A, is approved, and the
Mayor is authorized to execute the Amendment and to take -such other actions reasonably
necessary to carry out the intent of this Ordinance on behalf of the City, the execution of the
Amendment to the Intergovernmental Cooperation Agreement Between the City of Riverside,
Missouri and Southern Platte Fire Protection District being conclusive evidence of such
approval.
Section 4. The Mayor, the City Administrator, the City Attorney and other appropriate
City officials are hereby authorized to take any and all actions as may be deemed necessary or
convenient to carry out and comply with the intent of this Ordinance and to execute and deliver
for and on behalf of the City all certificates, instruments, agreements and other documents, as
may be necessary or convenient to perform all matters herein authorized.

Section 5. This Ordinance shall be in full force and effect from and after its passage and
approval.

AMENDMENT TO
THE INTERGOVERNMENTAL COOPERATION AGREEMENT
BETWEEN
THE CITY OF RIVERSIDE, MISSOURI
AND
SOUTHERN PLATTE FIItE PROTECTION DLSTRICT
THIS AMENDMENT (the "Amendment") to the Intergovernmental Cooperation
Agreement Between the City of Riverside, Missouri and Southern Platte Fire Protection District,
is made and entered into effective for all purposes and in all respects as of the 2 3 day of
2009, by and between THE CITY OF RIVERSIDE, MISSOURI ("City"), a fourth
class city and political subdivision of the State of Missouri and SOUTHERN PLATTE F1RE
PROTECTION DISTRICT ("District"), a political subdivision of the State of Missouri.
WITNESSETH:
WHEREAS, the City and the District entered into that certain Intergovernmental
Cooperation Agreement Between the City of Riverside, Missouri and Southern Platte Fire
Protection District dated May 1, 2008 whereby the parties agreed to provide assistance to each
other according to the terms therein ("Agreement").
WHEREAS, the City and the District have agreed to extend the terms of the Agreement
for one yeaz from the termination date of December 31, 2009 until December 31, 2010.
WHEREAS, the parties desire to amend the Agreement as follows:
1. Compeasatioa. Section 5 of the agreement shall be revised so that
compensation shall be as follows; In consideration for the District's furnishing
such equipment, personnel, and services, the City shall quarterly pay to
District an amount equal a sum of services rendered, as detailed in the most
current Missouri Department of Natural Resources Hazardous Substances
Emergency Response Cost Recovery Information. In consideration of the
payment of such sum of money, District agrees to pay all of its expenses of
organization, operation and all costs of acquiring, supplying and maintaining
the necessary personnel with which to control fire and provide medical first
response and light rescue services within the City response area. The City
shall pay no additional monies to District, except for reimbursement for
consumables, as set forth in Section 5 of the Agreement. In addition, the
responding District shall be reimbursed by the requesting City for
consumables utilized at the significant emergency site.
The City agrees to pay its quarterly obligation as outlined above for the
calendaz yeaz within thirty (30) days of an itemized, detailed bill. The
itemized, detailed bill will be submitted to the City, through the Director of
Public Safety for City at the end of each calendar quarter.
2. Termination of Aen~ Section 6 of the Agreement shall be revised so
that the terms of the Agreement shall continue until December 31, 2010.
3. Miscellaneous. Except as herein specifically modified and amended, the
Intergovernmental Cooperation Agreement Between the Ciry of Riverside,
Missouri and Southern Platte Fire Protection District remains unchanged and
is incorporated herein by reference. In the event of any conflict between the
terms and provisions of the Intergovernmental Cooperation Agreement
Between the City of Riverside, Missouri and Southern Platte Fire Protection
District and the terms and provisions of this Amendment, the terms and
provisions of this Amendment shall govern. All capitalized terms used in this
Amendment which are not defined herein shall have the meanings given to
said capitalized terms by the Intergovernmental Cooperation Agreement
Between the Ciry of Riverside, Missouri and Southern Platte Fire Protection
District.

Houston Lake Response Area
Inconsideration for the District's furnishing such equipment, personnel, and services, the
City shall annually pay to District an amount equal to $19,000.
In consideration of the payment of such sum of money, District agrees to pay all of its
expenses of organization, operation and all costs of acquiring, supplying and maintaining the
necessary personnel with which to control fire and provide medical first response and light
rescue services within the Houston Lake response area. The Ciry shall pay no additional
monies to District, except for reimbursement for consumables, as set forth in Section 5 of the
Agreement.
The City agrees to pay its annual obligation as outlined above for the calendar year within
thirty (30) days of the dated Agreement.

City Response Area
