HomeMy WebLinkAbout2009-12-01Minutes of Regulaz Meeting OF Boazd of Aldermen of City of Riverside, Missouri December 1, 2009 A regulaz session was held far the City of Riverside, Missouri, in the City Hall of Riverside, Missouri at 7:00 p.m. Those in attendance were Mayor Kathy Rose, Aldermen Thatcher, Bruns, Cope, Super, Fuller and Hurt. Also present were David Blackburn, City Administrator, Mike Duffy, Director of Community Development, Louise Rusick, City Clerk, Meredith Hauck, Community Relations Director, Donna Resz, Finance Dvector and Brian Hall, Interim City Attorney. Pledge of Allegiance Mayor Rose started the recital of the Pledge of Allegiance with the audience joining in, Mayor's comment Mayor Rose asked Tyson Spire-Sweet to come forward and said Tyson had accepted the recommendation for appointment as a member of the Planning and Zoning Commission. Mayor Rose introduced all of the Aldermen to Tyson and thanked him for accepting the position. Tyson is in Ward I and works for TranSystems and said he looks forward to serving on the Planning and Zoning Commission. Minutes of 11/l0/09 Alderman Thatcher moved to approve the minutes of November 10, 2009, Approved by Alderman Cope, the vote was: Aye: Aldermen Hurt, Super, Bruns, Thatcher, Fuller and Cope. Motion carries. City Adminisfrator David mentioned the memo he sent out regarding the City Clerk, Louise will comment retire on December 31, 2D09. David said the Deparhnent heads and himself are moving forward looking at the open positions collectively to see how re- structure may be involved and bring back the information to the next boazd meeting. Social Media Policy Meredith explained this policy outlines the protocol and procedures for use of social media to publicize official city services and events. Social media is changing the way we work, connect and communicate. Because social media is relatively new, understanding of liability issues is only now beginning to emerge. Based on this, it is important for the City to understand that any forays in social media-could result in a variety of situations that could negatively impact the City. In some instances, the City could face legal challenges if incorrect, false or non-public information is posted on a site use officially by the City or personally by employees or elected officials. Alderman Bruns moved to approve the social media policy, seconded by Alderman Thatcher, the vote was: Aye: Aldermen Cope, Super, Fuller, Hurt, Thatcher and Bruns. Motion caries. Mins. 12/1/09 Mike Duffy's comments The Briarcliff Development Agreement will be amended to clarify some things and brought back to the December 15'" meeting for request to approve. The City annex demolition starts on Monday, December 7`". The environmental cleanup is ending and final clearance from the Department of Natural Resources will be on Monday. Alderman Fuller asked who owns the waterfall at Briazcliff and Mike said right now a portion of the waterfall is on Briarcliff and some on City property. We own the property where the pump is prior to Briarcliff becoming involved with Riverside and that was acquired during the W. Platte Road project. The tap of the waterfall section is on Briarcliff property and will be deeded out and eventually, it will be fully owned by the City, The City will have the maintenance after one year. Next year the contractor will provide a performance bond on the waterfall and a maintenance agreement. City Engineer comment Sabin updated the beazd on Argosy Parkway North as they have been working with APAC-Kansas and a meeting will be held with them Wednesday before Thanksgiving and apre-construction meeting tomorrow at 3 p.m. A notice to proceed is anticipated for next week. APAC is experienced at working with the railroad bridge projects and they aze putting a schedule together as they are anticipatin a n b f i g um er o ssues. Sabin will get the formal schedule tomorrow and the project will start late Jan., Feb. or March and schedule completion is November I, 2010. Chief Mills comment Chief Mills said the present recorder was purchased in 2002 and is a critical piece of equipment and records all incoming calls. Over the past year there , have been seven instances of service interruption to the system and on Octoberl6a' it quit working and there aze no parts available for re l p acement. The vendor `Voice Products' gave Public Safety a loaner so they could record . It is certified through the purchasing program at the Mid America Regional Council and will be compatible with the new radio system. Tom, Public Works Dir. Tom said the brush /yard waste ordinance is being presented tonight for request comment to approve and Damon Purcell Recycling concurred with the fees and terms . There will be a yazd/waste invoice log developed and the legal aspects have been checked. The cost is $10.00 per pick-up pick up load and there is no limit on how many loads. Alderman Fuller said we do not want to subsidize someone's business. It was decided to amend the proposed ordinance. Alderman Thatcher said the Christmas Tree looks great at the Welcome Plaza Bill No. 2009-163 Alderman Thatcher moved to place Bill No. 2009-163 on its fast reading said Approving Payment of , Bill authorizing the payment of certain indebtedness listed therein, seconded by Indebtedness Alderman Fuller, the vote was: Aye: Aldermen Thatcher, Hurt, Bruns, Super, Fuller and Cope. Motion carries. Ordinance No. 2009-163 Alderman Fuller moved to place Bill No. 2009-163 on its second reading and Approved , upon passage of same become Ordinance No. 2009-163, seconded by Alderman Bruns, the vote was: Mins. 12/1/09 ~ Aye: Aldermen Hurt, Bruns, Cope, Thatcher, Super and Fuller. Motion carries. Bill No. 2009-165 Alderman Thatcher moved to place Bill No. 2009-165 on its first reading, said Establishing the Bill Establishing the Riverside Brush and Yard Waste Recycling Program, as Brush & Yard Waste amended Section 1 (adding from the'v City owned property only) seconded by Recycling Program Alderman Fuller, the vote was: Aye; Aldermen Bruns, Super, Fuller, Cope, Thatcher and Hurt. Motion carries. Ordinance No. 2009-165 Alderman Super moved to place Bill No. 2009-165 on its second reading, and Approved upon passage of same became Ordinance No. 2009-165 as amended, seconded by Alderman Cope, the vote was: Aye: Aldermen Super, Fuller, Cope, Thatcher, Hurt and Bruns. Motion carries. Bill No. 2009-166 Alderman Fuller moved to place Biil N. 2009-166 on its fast reading said Bill Authorizing the Purchase , Authorizing the Purchase and Retirement of Certain Bonds and Confirmati & Retirement of Certain on of the Purchase Price of Such Bonds as TIF Reimbursable Project Costs Under Bonds as TIP ............. The L-385 Levee Redevelopment Plan, as Amended, and Authorizing Other Documents and Actions Related Thereto, seconded by Alderman Cope, the vote was: Aye: Aldermen Fuller, Cope, Thatcher, Hurt, Bruns and Super. Motion carries. Alderman Fuller asked if this was money we are losing out on. Donna said "No"; we're gaining all the interest that we're not paying on the bonds. Mins. 12/1/09 Ordinance No. 2009-166 Alderman Fuller moved to place Bill No. 2009-166 on its second reading, and Approved upon passage of same become Ordinance No. 2009-166, seconded by Alderman Thatcher, the vote was: Aye: Aldermen Cope, Thatcher, Hurt, Bruns, Super and Fuller. Motion carries. Aldermen's comments regazding Alderman Super asked exactly what we would be responsible for with the agreement with MoDot fot Im rovem t th Bill No. 2009-167 p en s at e Rte 69 and Rte AA Intersection. Mike Duffy said this project was initiall looked t d y a an estimated to cost about $750,000, including some land acquisition and at the same time stimulus funds were applied for and received approximately $378,000. Negotiations were done with MoDot to provide the design work and c t i ons ruct on management for the project. We did provide the survey work and initial engineering by Cook, Flatt & Strobel MoDot agreed they would manage the project Their ti . es mate is the project will come in under $378,000, but the agreement said if there was anything over that we would be responsible. At budget time, $750,000 was approved, but when found out stimulus funds would be received, the amount was reduced by $375,000 and stimulus would pay the remaining amount. If the bids come in higher, we have seven days to consider it and decide if we want it or not. Alderman Fuller asked about any money the City would have to pay. Mike said if the bids ate higher than [he engineer's estimat e, we need [o take a look at i[ and see if it warrants a higher cost. The job will be let in January and in Mazch it should be obligated. Motion carries. Bill No. 2009-168 Alderman Thatcher moved to place Bill No. 2009-168 on its first reading, said Replacement of Voice Bill Authorizing the City Administrator as Purchasing Agent to Purchase a Recorder & Maint. Voice Recorder and Maintenance Policy for the Police Department, seconded For P.S. by Alderman Hurt, the vote was: Aldermen Hurt, Cope, Super, Thatcher, Burns and Fuller. Mins. 12/1/09 Motion conies. Ordinance No. 2009-168 Alderman Bruns moved to place Bill No. 2009-168 on its second reading, and Approved upon passage of same become Ordinance No. 2009-168, seconded by Alderman Thatcher, the vote was: Aye: Aldermen Cope, Thatcher, Hurt, Bruns, Super and Fuller. Motion carries. Mayor's Discussion Mayor Rose said we will be honoring Capital Electric at the Job Development Awards luncheon on December 11`s. Mayor Rose read a proclamation congratulating resident, Hareld "Bus" Bowman on his 100`" birthday. The Senior Citizen's luncheon will be next Tuesday, December 8'" at the Community Center at noon. Thursday night is the holiday lighting at 5:45 p.m. Board of Aldermen Alderman Bruns mentioned the timing on the traffic light on W. Platte Road. Alderman Fuller said we need more traffic lights at Woodland and Valley. Alderman Super wanted to reiterate what the Mayor said about the waterfall. and people are stopping to take pictures. Alderman Super asked if the temporary traffic light was a necessity at this time.
