HomeMy WebLinkAbout1993-10-26 Emergency MINUTES DF EMERGENCY MEETING OF BOARD OF ALDERMEN OF CITY OF RIVERSIDE, MISSOURI OCTOBER 26, 1993 An emergency meeting was called this 26th day of October, 1993, at 7:30 p. m. Those present were Aldermen Wedua, Karr, Teters, Marshall, Rule and Aust. Said meeting was called to order by Mayor Betty Burch. Mayar Burch said this emergency meeting was called with regard to the hauling of dirt an Narthwaad Road fr^orn the area west of Nar^thwood Raad and of the many complaints regarding the dust, condition of the road and lack of courtesy of the drivers hauling the dirt. Mayor Burch said she had met with the Missouri State Highway Department people to show and discuss the State Right of Way location. They acknowledged that part of Northwood Raad is awned by them. Also the Special Raad District had a sur^vey made and it appears roast all of Narthwaad Road, as it now stands, in the City of Riverside. Mayor Burch was advised that Michael Purcell, owner of the property west of Northwood Raad, did put same crusher run gravel on the hill adjacent to Highway No. 9, however, this has done very little to improve the condition. Mayor Burch said while she was with the Highway Department people she counted 26 trucks in 3@ minutes going aver this road. Mayar Burch also brought out that one of the neighbors, living very close to the road is very ill and the dust is causing a hardship on him. Fred Sanchez, a resident west of Michael Purcell's property showed a video of the trucks hauling the dirt from excavating site and the condition of the road on October 23 and 24, 1993. The video showed how rough the road is and the danger of smaller vehicles going an the road while the large trucks are hauling the dirt. He said that the City could make a boulevard of Northwood Road, which would keep the trucks from going on the Road. Mayor Burch said she could oat believe what a terrible condition the road was in and northing had been done to improve it by Michael Purcell. Michael Gunn, Attorney far Michael Purcell said that he was here an short notice. He said this was an eleven day project and there are six remaining days. Then they will be hauling dirt for the levee and other pra~ects. He said they have heretofore repaired the road and when they are completed with dirt hauling, they will put the road in exact condition as it was before the hauling. He said they will put flagmen on highway if necessar^y. He also said that he would like to t f Page :?, Min. of Reg. They would like to take the necessary steps far the annexation. Michael Pur^cell said that he wants to be a good neighbor and would like to work. this matter out, that he had only two ar three hour notice about this meeting. Alderrnan Rule said he has been ari the board for almost six years and it seemed like this hauling of dirt from this area was going an then and the road was in bad condition frarn the hauling. He wanted to know haw much more dirt was going to be hauled. It was brought out that in the 1980s the City had spent '.680,00@, plus, on improving the road and the Special Road District spent s620, 000. Mayor Fi~.irch asked what are they going to da with the road now and after the five or six days hauling far^ this one particular project. Michael Purcell said he would like to work with the City and could have water p~_~t an the rand to hold down the dust. Attorney Gunn said they would like to work with the City before they pass any ordnance cantr^ol l ing the ~_~se c ~f the road. We would like to have a long term agreement on the use of the r^aad. Gary Wahl, inquired as to what Ordnance 22.07 was which said that hauling of this type material could not be done an Saturday and Sunday and Ordinance 14.67 in the County. He said that the levee is going to have lots of need far this type of filling and feels it is necessary to continue this pr^a~ect. Alderman Rule said he thought it was the responsibility of Michael Purcell to repair the road and keep it in repair. and feels they should concrete the r^oad so it will hold up under the heavy loads being hauled. Alderrnan Teters said she drove aver Northwood road last Saturday and did not think it was taa bad until she carne to the south end and then it was in bad condition. bob Gieseke spoke an behalf of the Quindara Levee Fiend District and would need dirt far the repair of the levee.. He said they thought it would be better if the dirt was closer since it would cast less. He said he has mixed feelings on this since he servers an the Conservation F Page 3, Mir,. of Reg. There is lots of sail erosion, coming from this project which casts the tax payers lots c,f money and something should be done about the erasiar or, this pra~ect. The City wants the plan in writing and wants the r^aad repair^ed an Wednesday, October 27, iS93 or will shut dawn, the entire project until something is worked out. The City wants definite answers an what Purcell is going to do with the road. Alderrnar, Karr is of the same opinion. Michael Rurcell said that he would like to meet with the City to see what repairs should be done to the road. Mayor Burch said that there should be a stop sign far all the trucks Gaming out of the Pur^cell's property before entering Northwood Raad. That the entrance to Ncrthwood Raad sh ould be changed from its present place to a mare northern entrance. There should also be stay sign at the entrance an the highway. These signs should be observed faithfully which would make it safer far the cars that travel over this road. Also the tube drainage is such that it carves down the hill and almost caused the pump lift station tc~ flood during one of the rains. This dr^ainage tube should be changed to a different direction. Mayor Burch said that it is the City's responsibility to do something about this road and the flooding of the pump lift station and they plan to do something. Alderman Jahn Marshall said that he was the person to report the flooding of the pump lift station ar,d it appear^ed to be running fram the Northwood Raad, and the culvert sh,~uld be changed sa the runoff will ga in a different direction,. Michael Purcell said he would like to meet with the City and work out something. Lillie Trimble spoke and said prior to her coming to the meeting she understood that the County has entered three stop or^ders tc, Michael Purcell. She said they have an interest in .this project because they have property dust north of this. Mayor Burch said that the City's zoning ar^der is mare strict than the County's. Michael Purcell said he would asphalt the road. Alderman Aust said she would like to see the C~~unty's regulations. Mayor Burch said the City needs something in writing r_,n what Michael Purcell is going to da this. Alder^rnan Wedua said he would like t+~ tak.e the blame far this because the first part of the year Purcell Construction was going to asphalt the hill and I didn't get the dab done. I told the supervisor that we would like to get this done before the rain and he was out of town and I apalr_,gize. We need to get ride of the culvert where it is and we will fig~_ire out where the culvert should ga. Mayor Burch said that what we want is stop sign, the culvert under the road changed, need an impact study to give the city same kind of direction now to the end, something to control the dust, the relocation of the entrance ar exit, the raced repaired irnrnediately. Alderman Aust wants to see the application of BFI with the County. Mayor Burch said there will be a meeting tomorrow, October 27, 1993, in the City Hal l at 10:00 a. rn, and wo~_rld invite the City Engineer to discuss further the Nar^thwaad Road. City Attorney Dan Witt said he thought there would be Borne liability exceptions to the City. He also said that the City will not blindly accept where the road is frarn the Special Raced District. The City needs the grading range, long r^ange, carne basis where it is going, same impact study far the City. Need specifications as to getting the trucks in and out. City Attorney Dan Witt spoke to the Mayor and Board of Aldermen concerning the Argosy Gaming Company with regard to the band. Alderman Rule was concerned about the 6.6 million dollars in escrow being safe and Attorney Witt assured the i F~age 5, Min. of Reg. Meet. , 10-~6-93 City that it was. Also the City will receive the ~33,3Q~~D per month rental an the park property so long as they use it fur their gaming purposes.
