R'HEREAS, Service Provider desires to continue to provide such services and requires funding to continue to provide services within the City. WIIEREAS, the City finds that the provision of the Services is a public purposes and the City has the capabilit}~ and desire to assist Service Provider in continuing to provide Services to the public within the City. NO~~', THEREFORE, BE I'I' ORllAINED, by the Board of Alderman of Riverside, Missouri, as follows: Section 1. The City ftnds that the provision of the Services conn'ibutes to the welfare of the City as well as dre economic and social potential of the City and its residents, that the Services are important to the welfare of the City and that the provision of funds to assist in providing such Services are for a public purpose. Section 2. The City of Riverside shall pay to the Service Provider the sum of Ten Thousand and 00.100 Dollars (510,000.00) to assist it in continuing to provide services to the residents of the City and the City, pursuant to a Services Agreement, in substantiall}' the form attached as Exhibit A, which is hereby approved. Section 3. The Mayor and Cily Clerk are authorized and directed to execute the Services Agreement with such changes as such officer shall approve, execution of such document being conclusive proof of such approval. The Mayor, City Clerk and City Administrator are each authorized and directed to perfom~ all acts and execute any other docmnents necessary or desirable to effectuate the intent of this Ordinance. The City Clerk is hereby authorized and directed to ensure that a check in the amount described in Section 2 is drafted and presented to an authorized official of the Service Provider, upon execution of the Services Agreement. Section 4. The sections, paragraphs, clauses, and pln~ases of the Ordinance arc severable and if any portion of the Ordinance is declared unlawful by the valid judgment, decree, or injunction order of a court of competent jurisdiction, such ruling shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of the Ordinance and all provisions of the Ordinance not specifically declared to be unlawful shall remain in full force and effect. Section 5. This ordinance shall take effect immediately. ADOPTED AND PASSED TIllS 21~` DAY OP DECEMBER, 2004. ATTEST: . i I /' r ' ~'. ~ .~ tee, CITY CLERK MAYOR OF :YIG CITY OF RIVERSIDE `~i SERVICES AGREEMENT THIS SERVICES AGREEMENT entered into on this 21" day of December, 2004, by and between the CITY OF RIVERSIDE, MISSOURI ("City"), and the SALVATION ARMY ("Service Provider"). WHEREAS, Service Provider is anot-for-profit organization providing services, including certairt health, emergency and safety services, to residents of the City. WHEREAS, Service Provider desires to continue to provide such services and requires funding to continue to provide services within the City. WHEREAS, the City has found that the provision of the Services contributes to the welfare of the City as well as the economic and social potential of the City and its residents, that the Services are important to the welfare of the City and that the provision of funds to assist in providing such services are for a public purpose. WHEREAS, the City has the capability and desire to assist Service Provider in continuing to provide services to the public within the City. IN CONSIDERATION of the mutual covenants and agreements set forth herein, the parties agree to the following: 1. Tliat Service Provider shall provide the Services (defined below) for the City and/or its residents for the next ensuing 12 months pursuant to the terms of this Service Agreement. 2. That the City shall pay to Service Provider the sum of $10,000.00. 3. That the Services provided by Service Provider shall include activities designed for the purpose of aiding public health and safety within the City, including, but not limited to, assisting the poor, hungry and homeless within the City, and providing emergency assistance and disaster relief within the City, in accordance with the policies and procedures of Service Provider. IN WITNESS WHERE, the parties have executed this Agreement the day and year first above written.
