ORDINANCE NO. 2003-06
AN ORDINANCE AMENDING CHAPTER 500 OF THE MUNICIPAL CODE OF THE
CITY OF RIVERSIDE, MISSOURI, BY REPEALING CERTAIN PROVISIONS
CONTAINED THEREIN AND ENACTING NEW MUNICIPAL CODE
PROVISIONS REGARDING THE CONSTRUCTION AND
MAINTENANCE OF STRUCTURES AND PROPERTY
WITHIN THE CITY AND THE ADOPTION OF
INTERNATIONAL CODES
WHEREAS, the City and its staff have conducted a comprehensive review of the city
code sections relating to the construction and maintenance of structures and property within the
City, as well as the technical codes adopted with regard to such issues; and
WHEREAS, certain technical codes concerning the construction and maintenance of
structures within the City have been reviewed by the City for incorporation by reference, and the
Board of Aldermen has deemed such adoption to be advisable and in the City's best interests for
the promotion of the health, safety and welfare of the residents of the City; and
WHEREAS, three copies of such technical codes were filed in the office of the City
Clerk and kept available for public use, inspection and examination for a period of time in excess
of ninety (90) days preceding the adoption of this Ordinance, all as provided by Section 67.280
RSMo.; and
WHEREAS, the Board of Aldermen of the City of Riverside, Missouri finds that it is in
the best interests of the citizens of the City of Riverside to enact provisions of the Code
Adoptions Ordinance set forth herein;
NOW, THEREFORE, BE IT ORDAINED by the Board of Aldermen of the City of
Riverside, Missouri, as follows:
Section I. Article I. Building Code Adoption, Article II. Plumbing Code Adoption,
Article III. Mechanical Code Adoption, Article V. Fire Code, and Article VI. Cabo One- and
Two-Family Dwelling Code, all contained within Chapter 500 of the Municipal Codc of the City
of Riverside, Missouri, are hereby repealed and replaced, and shall read in their entirety, as
follows:
TITLE V. BUILDING AND CONSTRUCTION
CHAPTER 500: CODE ADOPTIONS
ARTICLE 1. BUILDING CODE
SECTION 500.010: ADOPTION OF THE INTERNATIONAL BUILDING CODE
A. Adoption. The International Building Code, 2000 Edition, as published by the International
Code Council, Inc., is hereby enacted and made a part of this Section by reference except as
to portions hereinafter specifically deleted, clarified or amended.
B. Conflicts. If any conflict should exist between the International Building Code and the
Zoning Code of the City of Riverside, Missouri, the provisions of the Zoning Code shall
control. If any conflict should exist between the International Building Code and any other
ordinance of the City of Riverside, Missouri, the International Building Code provisions shall
control and the portion of the ordinance in conflict with the International Building Code shall
be repealed. Such repeal will affect only that portion of any ordinance, which is in conflict
with the International Building Code and shall not affect any other portions of the ordinance.
ARTICLE II. PLUMBING CODE ADOPTION
SECTION 500.020: ADOPTION OF THE INTERNATIONAL PLUMBING CODE
A. Adoption. The International Plumbing Code, 2000 Edition, is hereby enacted and made a
part of this Section by reference except as to portions hereinafter specifically deleted,
clarified or amended.
B. Conflicts. 1f any conflict should exist between the International Plumbing Code and the
Zoning Code of the City of Riverside, Missouri, the provisions of the Zoning Code shall
control If any conflict should exist between the International Plumbing Code and any other
ordinance of the City of Riverside, Missouri, the International Plumbing Code provisions
shall control and the portion of the ordinance in conflict with the International Phimbing
Code provision shall be repealed. Such repeal will affect only that portion of any ordinance,
which is in conflict with the International Plumbing Code and shall not affect any other
portions of the ordinance.
ARTICLE III. MECHANICAL CODE
SECTION 500.030: ADOPTION OF THE INTERNATIONAL MECHANICAL CODE
A. Adoption. The International Mechanical Code, 2000 Edition, is hereby enacted and made a
part of this Section by reference except as to portions hereinafter specifically deleted,
clarified or amended.
B. Conflicts. If any conflict should exist between the International Mechanical Code and the
Zoning Code of the City of Riverside, Missouri, the provisions of the Zoning Code shall
control. If any conflict should exist between the International Mechanical Code and any
other ordinance of the City of Riverside, Missouri, the International Mechanical Code
provisions shall control and the portion of the ordinance in conflict with the International
Mechanical Code provision shall be repealed. Such repeal will affect only that portion of any
ordinance, which is in conflict with the International Mechanical Code and shall not affect
any other portions of the ordinance.
ARTICLE V. FIRE CODE
SECTION 500.050: ADOPTION OF INTERNATIONAL FIRE CODE
A. Adoption. The International Fire Code, 2000 Edition, is hereby adopted and made a part of
this Section by reference except as to portions hereinafter specifically deleted, clarified or
amended.
C. Violation: Penalties. Any person violating any provision of said Code may be punished by a
fine of not more than five hundred dollars ($500.00) or by imprisonment not in excess of
ninety (90) days, or by both said fine and imprisonment.
ARTICLE VI. RESIDENTIAL CODE FOR ONE- AND TWO-FAMILY DWELLINGS
SECTION 500.055: ADOPTION OF INTERNATIONAL RESIDENTIAL CODE FOR
ONE- AND TWO-FAMILY DWELLINGS
A. Adoption. The International Residential Code for One- and Two-Family Dwellings, 2000
Edition, is hereby enacted and made a part of this Section by reference except as to portions
hereinafter specifically deleted, clarified or amended.
B. Conflicts. If any conflict should exist between the International Residential Code for One-
and Two-Family Dwellings and the Zoning Code of the City of Riverside, Missouri, the
provisions of the Zoning Code shall control. If any conflict should exist between the
International Residential Code for One- and Two-Family Dwellings and any other ordinance
of the City of Riverside, Missouri, the International Residential Code for One- and Two-
Family Dwellings provisions shall control and the portion of the ordinance in conflict with
the International Residential Code for One- and Two-Family Dwellings provision shall be
repealed. Such repeal will affect only that portion of any ordinance, which is in conflict with
the International Residential Code for One- and Two-Family Dwellings and shall not affect
any other portions of the ordinance.
Section 2. The provisions of the Municipal Code of the City of Riverside, Missouri
repealed herein shall not be construed to revive any former ordinance, clause or provision of the
Municipal Code of the City of Riverside, Missouri.
Section 3. The sections, paragraphs, clauses, and phrases of the Ordinance are
severable and if any portion of the Ordinance is declared unlawful by the valid judgment, decree,
or injunction order of a court of competent jurisdiction, such ruling shall not affect any of the
remaining phrases, clauses, sentences, paragraphs, and sections of the Ordinance and all
provisions of the Ordinance not specifically declared to be unlawful shall remain in full force
and effect.
Section 4. This ordinance overrides any conflicting provision or regulation within the
Municipal Code of the City of Riverside, Missouri.
Section 5. This ordinance shall take effect immediately.
