ORDINANCE NO. ~~~~
AN ORDINANCE APPROVING AMENDMENTS TO THE GATEWAY
GRANT AND LOAN REVITALIZATION PROGRAM
ADMINISTRATIVE MANUAL.
WHEREAS, in accordance with the Real Property Tax Increment Allocation
Redevelopment Act, Sections 99.800 to 99.865 of the Revised Statutes of Missouri, as amended
(the "Act"), the Board of Aldermen of Riverside, Missouri (the "Board of Aldermen"), pursuant
to Ordinance No. 2001-108, enacted on October 2, 2001, adopted and approved the Gateway
Redevelopment Plan (the "Gateway Plan") in order to facilitate the improvement, revitalization
and remediation of blighting conditions on properties located within the Gateway
Redevelopment Area (the "Gateway Redevelopment Area");
WHEREAS, in accordance with the Gateway Plan, the Board of Aldermen adopted and
created the Gateway Grant and Loan Revitalization Program (the "Program") pursuant to
Ordinance No. 2002-06, adopted by the Board of Aldermen on January 15, 2002, to provide
grant and loan funding for eligible improvements to properties located within the Gateway
Redevelopment Area;
WHEREAS, in accordance with the Act, the Board of Aldermen adopted and approved
the L-385 Levee Redevelopment Plan, pursuant to Ordinance No. 96-72, enacted on July 16,
1996, and modified, supplemented and amended the L-385 Levee Redevelopment Plan by
Ordinance No. 97-10, Ordinance No. 97-I1, Ordinance No. 97-12 and Ordinance No. 97-13, all
enacted by the Board of Aldermen on February 4, 1997; Ordinance No. 97-95 enacted by the
Board of Aldermen on August 19, 1997; Ordinance No. 99-34 enacted by the Board of Aldermen
on May 4, 1999; Ordinance No. 99-61 enacted by the Board of Aldermen on August 17, 1999;
Ordinance No. 99-94 enacted by the Board of Aldermen on December 7, 1999; and Ordinance
No. 2001-115 enacted by the Board of Aldermen on October 9, 2001 (as modified, supplemented
and amended, the "L-385 Plan"), in order to facilitate the improvement, revitalization and
remediation of blighting conditions on properties located within the L-385 Levee Redevelopment
Area (the "L-385 Redevelopment Area");
WHEREAS, the Board of Aldermen amended the Gateway Plan, pursuant to Ordinance
No. 2002-131, enacted on December 17, 2002, and further amended the L-385 Plan, pursuant to
Ordinance No. 2002-130, enacted by the Board of Aldermen on December 17, 2002 to
incorporate the Program into the L-385 Plan and to provide grant and loan funding under the
Program for eligible improvements on properties located either within the Gateway
Redevelopment Area or within designated portions of the L-385 Redevelopment Area; and
WHEREAS, amendments to the Program Administrative Manual are proposed in order to
implement the amendments to the Gateway Plan and the L-385 Plan, to provide grant and loan
funding under the Program for eligible improvements on properties located either within the
Gateway Redevelopment Area or within designated portions of the L-385 Redevelopment Area,
to clarify the City's funding procedures for Program grants and loans, and to clarify the duties
and responsibilities of the recipient property owners with regard to maintenance of the
improvements funded under the Program and the continuance of the recipient's business
operations on the property.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF RIVERSIDE, MISSOURI AS FOLLOWS:
Section I. The First Amendment to the Gateway Grant and Loan Revitalization Program,
Administrative Manual attached hereto as Exhibit A, is approved.
Section 2. This Ordinance shall be in full force and effect from and after its passage and
approval.
