HomeMy WebLinkAbout2003-034 - Amendments to Chapter 700 of the Municipal CodeBILL NO. 2003-34 ORDINANCE NO. 2003-34 AN ORDINANCE AMENDING TITLE VII, CHAPTER 70U OF THE MUNICIPAL CODE OF THE CITY OF RIVERSIDE, MISSOURI, BY AMENDING A PROVISION REGARDING SEWER BILLS WHEREAS, the legislature of the State of Missouri revised Section 250.140 of the Revised Missouri Statutes in its 2002 legislative session to include new language regarding notice requirements for termination of service; and WHEREAS, the City of Riverside, Missouri (the "City") and its staff have conducted a comprehensive review of the City's Municipal Code (the "Code") sections regarding sewer bills and have determined that the new language added by the Missouri Legislature in 2002 is not included in the current version of the Code; and WHEREAS, the City staff and the Board of Aldermen have reviewed, examined and deemed adoption of the amendment to be advisable and in the City's best interests for the promotion of the health, safety and welfare of the residents of the City; and WHEREAS, the City deems it advisable to harmonize, to the extent possible, its ordinances with the statutes of the State. NOW, THERFORE, be it ordained by the Board of Aldcnnen of the City of Riverside, Missouri, as follows: Section 1. Section 700.020 of the Municipal Code of the City of Riverside, Missouri is hereby amended to read as follows: SECTION 700.020: SEWER BILLS-LATE FEES, PROPERTY OWNER AND OCCUPANT LIABLE, DELINQUENCIES TO BECOME A LIEN UPON THE LAND, NOTICE REQUIREMENTS [Subsections A.-D. are unchanged.] E. Notices. Any notice required under this Section shall be deemed given when deposited by the City in the United States mail, first class, postage pre-paid, addressed to the last address appearing the City records for the occupant and user of the premises or for the owner of the premises. If the occupant of the premises receives the billing, any notice of termination of service shall be sent to both the occupant and owner of the premises receiving such service, if such owner has requested in writing to receive any notice of termination and has provided the entity rendering such service with the owner's business addresses. The provisions of the Municipal Code of the City of Riverside, Missouri amended herein shall not be construed to revive any former ordinance, clause or provision of the Municipal Code of the City of Riverside, Missouri. Section 3. The sections, paragraphs, clauses, and phrases of the Ordinance are severable and if any portion of the Ordinance is declared unlawful by the valid judgment, decree, or injunction order of a court of competent jurisdiction, such ruling shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of the Ordinance and all provisions of the Ordinance not specifically declared to be unlawful shall remain in full force and effect. Section 4. This ordinance overrides any conflicting provision or regulation within the Municipal Code of the City of Riverside, Missouri. Section 5. This ordinance shall take effect immediately.
