HomeMy WebLinkAbout2003-041 - Amendments to Chapters 315, 325, and 340 of the Municipal CodeBILL NO. 2003-41 ORDINANCE NO. 2003-41 AN ORDINANCE AMENDING TITLE III, CHAPTERS 315, 325, .AND 340 OF THE MUNICIPAL CODE OT' THE CITI' OF RIVERSIDE, MISSOURI, BY AMENDING PROVISIONS REGARDING PEDESTRIAN AND TRAFFIC REGULATIONS WHEREAS, the legislature of the State of Missouri revised provisions of the Model Traffic Ordinauees in its 2002 legislative session; and WHEREAS, the City of Riverside, Missouri (the "City") and its staff have conducted a comprehensive review of the City's Municipal Code (the "Code") sections regarding traffic regulations and have determined that the language changed by the Missouri Legislature in 2002 is not properly reflected in the current version of the Code; and WHEREAS, the City staff and the Board of Aldermen have reviewed, examined and deemed adoption of the amendments to be advisable and in the City's best interests for the promotion of the health, safety and welfare of the residents of the City; and WHEREAS, the City deems it advisable to harmonize, to the extent possible, its ordinances with the statutes of the State. NOW, THERFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri, as follows: Section 1. Sections 315.070, 325.010, 340.010, and 340.110 of the Municipal Code of the City of Riverside, Missouri are hereby amended as follows: SECTION 315.070: PEDESTRIAN CONTROL SIGNALS Whenever special pedestrian control signals exlubiting the words "Walls" or "Don't Walls", or other appropriate symbols, are in place such signals shall indicate as follows: [Subsections 1. and 2. are unchanged.] SECTION 325.010: REQUIRED POSITION AND METHOD OF TURNING AT INTERSECTION The driver of a vehicle intending to turn at an intersection shall do so as follows: 1. Right turns. Both the approach for a right turn and a right turn shall be made as close as practicable to the right-hand curb or edge of the roadway, except where multiple turn lanes have been established. [Subsection 2. is unchanged.] 3. Left tzn-ns o~~ other than lwo-wcn~ roadtivay~s. At any intersection is restricted to one (1) direction on one (1) or more of the roadways, the driver of a vehicle intending to turn left at any such intersection shall approach the intersection in the extreme left-hand lane lawfully available to traffic moving in the direction of travel of such vehicle and after entering the intersection the left turn shall be made so as to leave the intersection, as nearly as practicable, in the left-hand lane lawfiilly available to traffic moving in such direction upon the roadwa}~ being entered, except where multiple hu-n lanes have been established. 4. Desig~ulted nvo-wcrr left turn lmzes. Vdhere a special lane for malting left turns by drivers proceeding in opposite directions have been indicated by official traffic control devices: a. A left ttu-n shall not be made fi-om any other lane; b. A vehicle shall not be driven in the lane except when preparing for or making a ]efi turn fi-om or into the roadway or when preparing for or malting a u-tuns when otherv~~ise permitted by law; a A vehicle shall not be driven in the lane for a distance of more than five hundred (500) feet. SECTION 340.010: FOLLOWING FIRE APPARATUS PROHIBITED The diver of any vehicle other than one on official business shall not follow any emergency vehicle traveling in response to an emergency call closer than five hundred (500) feet or drive into or park such vehicle within the block where fire apparatus has stopped in answer to afire alam~. SECTION 340.1 ] 0: ALL-TERRAIN VEHICLES, PROHIBITED-EXCEPTIONS, OPERATION OF UNDER AN ENCEPTION-PROHIBITED USES-PENALTY [Subsections A.-B. are unchanged.] C. A person operating an all-terrain vehicle on a street or highway pursuant to an exception covered in this Section shall have a valid license issued by a state authorizing such person to operate a motor vehicle, but shall not be required to have passed an examination for the operation of a motorcycle, and the vehicle shall be operated at speeds of less than thirty (30) miles per hour. When operated on a street or highway, an all-terrain vehicle shall have a bicycle safety flag, which extends not less than seven (7) feet above the ground, attached to the rear of the vehicle. The bicycle safety flag shall be hiangular in shape with an area of not less than thirty (30) square inches and shall be dayglow in color. [Subsections D.-F. are unchanged.] Section 2. The provisions of the Municipal Code of the City of Riverside, Missouri revised and/or enacted herein shall not be construed to revive any former ordinance, clause or provision of the Municipal Code of the City of Riverside, Missouri. Section 3. The sections, paragraphs, clauses, and phrases of the Ordinance are severable and if any portion of the Ordinance is declared unlawful by the valid judgment, decree, or injunction order of a court of competent jurisdiction, such ruling shall not affect any of the remaining phrases, clauses, scntcuces, paragraphs, and sections of the Ordinance and all provisions of the Ordinance not specifically declared to be unlawful shall remain in full force and effect. Section 4. This Ordinance overrides any conflicting provision or regulation within the Municipal Code of the City of Riverside, Missouri. Section ~. This ordinance shall take effect immediately.
