HomeMy WebLinkAbout2003-042 - Amendments to Chapter 375 of the Municipal CodeSILL NO. 2003-42 ORDII~r.ANCE NO. 2003-42 AN ORDINANCE AMENDING TITLE III, CHAPTER 37i OF THE MUNICIPAL CODE OF THE CITY OF RIVERSIDE, MISSOURI, BY REVISING A PROVISION REGARDING THE ISSUANCE OF A UNIFORM SUMMONS AND COMPLAINT WHEN A VEHICLE IS PARKED OR STOPPED ILLEGALLY WHEREAS, the legislature of the State of Missouri revised provisions of the Model Traft"ic Ordinances in its 2002 legislative session; and WHEREAS, the City of Riverside, Missouri (the "City") and its staff have conducted a comprehensive review of the City's Municipal Code (the "Code") sections regarding u-affic regulations and have determined that the language changed by the Missouri Legislature in 2002 is not properly reflected in the cun-ent version of the Code; and WHEREAS, the City staff and the Board of Aldermen have reviewed, c~amined and deemed adoption of the amendments to he advisable and in the City's best interests for the promotion of the health, safety and welfare of the residents of the City; and WHEREAS, the City is required by State law to harmonize, to the extent possible, its ordinances with the statutes of the State. NOW, THERPORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri, as follows: Section 1. Section 375.030 of the Municipal Code of the City of Riverside, Missouri is hereby amended, and shall read as follows: SECTION 37.030: UNIFORM SUMMONS AND COMPLAINT TO BE ISSUED WHEN VEHICLE ILLEGALLY PARKED OR STOPPED Whenever any motor vehicle without driver is found parked or stopped in violation of any of the restrictions imposed by ordinances of the city or by state law, the officer finding such vehicle shall take its registration number and may take any other inforniation displayed on the vehicle which may identify its user, and shall conspicuously affix to such vehicle a uniform summons and complaint or other citation for the driver to answer to the charge against him within seven (7) days during the hours and a place specified in the traffic ticket. Section 2. The provisions of the Municipal Code of the City of Riverside, Missouri revised herein shall not be construed to revive any former ordinance, clause or provision of the Municipal Code of the City of Riverside, Missouri. Section 3. The sections, paragraphs, clauses, and phrases of the Ordinance are severable and ii' any portion of the Ordinance is declared unlawfiil by the valid judgment, decree, or injunction order of a court of competent jurisdiction, such ruling shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of the Ordinance and all provisions of the Ordinance not specifically declared to be unlawful shall remain in full Corce and effect. Section 4. Tlus Ordinance overrides any conflicting provision or regulation within the Municipal Code of the City of Riverside, Missouri. Section 5.
