AN ORDINANCE AUTHORIZING AND APPROVING THE CITY OF RIVERSIDE,
MISSOURI, TO ACQUIRE CERTAIN LAND AND IMPROVEMENTS AND
ALL ASSOCIATED APPURTENANCES AND IMPROVEMENTS BY
EXERCISE OF ITS POWER OF EMINENT DOMAIN IN THE
EVENT IT IS UNABLE TO ACQUIRE THE PROPERTY
THROUGH AGOOD-FAITH OFFER AND
SUBSEQUENT PURCHASE
WHEREAS, the City of Riverside, Missouri (the "City") is authorized by Missouri
statute to acquire, through purchase, eminent domain or other methods, private property for
public use, including for the purpose of widening, extending and/or altering any street or avenue;
and
WHEREAS, the City desires to so acquire certain portions of real property, such portions
as described at Exhibits A, B, and C (the "Properties" or, if referred to individually, the
"Property"), for the purpose of widening, altering and repairing a city street; and
WHEREAS, the City desires to make an attempt to reach agreements for purchase of the
Properties as hereafter provided; and
WHEREAS, the City will engage in negotiations for the acquisition of the Properties but
nay be unable to reach an agreement for purchase with the owners of the Properties; and
WHEREAS, if the City is unable to successfully purchase the Properties through good-
faith negotiations with the owners of the Properties, the City desires to acquire the Properties
through eminent domain;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS:
Section 1. This Ordinance is intended and is hereby determined and declared to be necessary
to accomplish and serve the public purpose of altering and/or repairing a city street or avenue by
obtaining the Properties, which Properties are thereby to be put to a vital and necessary public
use and purpose.
Section 2. The City shall make an offer not to exceed the amount of Seventeen Thousand
Nine Hundred Seventy Nine and No/100 Dollars ($17,779.00) to acquire the fee ownership
interest in the Property described in Exhibit A attached hereto and incorporated herein by
reference, by negotiation for permanent right of way and temporary construction easements.
Section 3. The City shall make an offer not to exceed the amount of Three Thousand Seven
Hundred Ninety Five and No/100 Dollars ($3,795.00) to acquire the fee ownership interest in the
Property described in Exhibit B attached hereto and incorporated herein by reference, by
negotiation for permanent right of way, temporary constniction easements and a permanent
drainage easement.
Section 4. The City shall make an offer not to exceed the amount of Forty Three Thousand
Three and No/100 Dollars ($43,003.00) to acquire the fee ownership interest in the Property
described in Exhibit C attached hereto and incorporated herein by reference, by negotiation for
permanent right of way, a temporary construction easement and a permanent drainage easement.
Section 5. Should, after the City has made the offers described in Sections 2 through 4
above, certain or all of the owners determine not to accept the City's final good-faith offer to
acquire the fee ownership interest in the separate Properties, it shall be deemed that the City has
been unable to acquire the certain or all of the Properties through good faith negotiations.
Section 6. If the City is not able acquire to any of the Properties through good faith
negotiations, including agood-faith final offer to purchase, the acquisition of such Property(ies)
through the City's power of eminent domain is authorized and approved pursuant to the authority
vested in the City by and under the Constitutions, laws, ordinances, rules and regulations of the
City, the State of Missouri and of the United States of America, including, without limitation,
RSMo. § 88.667 and Missouri Rules of Civil Procedure, Rule 86.
Section 7. The Mayor, the City Administrator, the City Attorney and other appropriate City
officials are hereby authorized to take any and all actions as may be deemed necessary or
convenient to carry out and comply with the intent of this Ordinance and to execute and deliver
for and on behalf of the City the final offer, negotiation documents, a petition for condemnation,
all certificates, instruments, agreements and other documents as may be necessary or convenient
to perform all matters herein authorized.
Section 8. This Ordinance shall be in full force and effect from and after its passage and
approval.
