HomeMy WebLinkAbout2003-083 - Amendments to Chapter 600 of the Municipal CodeBILL NO~~D~ D~ ORDINANCE NO ~~0-~-~~ AN ORDINANCE AMENDING CHAPTER 600 OF THE MUNICIPAL CODE OF THE CITY OF RIVERSIDE, MISSOURI, BY AMENDING PROVISIONS REGARDING THF, SALE AND CONSUMPTION OF ALCOHOLIC BEVERAGES WITHIN THE CITY ON SUNDAYS WHEREAS, the City and its staff have conducted a comprehensive review of the city code sections relating to the sale and consumption of alcoholic beverages within the City; and WHEREAS, the Missouri General Assembly has passed Senate Bill 298, which amends state statutes regarding the sale and consumption of alcoholic beverages, and the Board of Aldermen has reviewed, examined and deemed adoption of the provisions to be advisable and in the City's best interests for the promotion of the health, safety and welfare of the residents of the City; NOW, THEREFORE, BE IT ORDAINED by the Board of Aldermen of the City of Riverside, Missouri, as follows: Section 1. Sections 600.310 and 600.340, both contained within Title VI, Chapter 600 of the Municipal Code of the City of Riverside, Missouri, are hereby amended as follows: SECTION 600.310: TIME FIXED FOR OPENING AND CLOSING PREMISES (EXCEPT SUNDAY SALES AND SUNDAY PACKAGE LIQUOR LICENSES)-CLOSED PLACE DEFINED-PENALTY A. Except as provided in Section 600.340, no person having a license under this Chapter, nor any employee of such person, shall sell, give away, or otherwise dispose of, or suffer the same to be done upon or about his/her premises, any intoxicating liquor in any quantity between the hours of 1:30 A.M. and 6:00 A.M. on weekdays and between the hours of 1:30 A.M. Sunday and 6:00 A.M. Monday. B. Except as provided in Section 600.340, if a person has a license to sell intoxicating liquor by the drink, his/her premises shall be and remain a closed place, as defined in Subsection (C) of this Section, between the hours of 1:30 A.M. and 6:00 A.M. on weekdays and between the hours of 1:30 A.M. Sunday and 6:00 A.M. Monday. 1. Where such licenses authorizing the sale of intoxicating liquor by the drink, as specified in Subsection (B) of this Section, are held by clubs or hotels, this Section shall apply only to the room or rooms in which intoxicating liquor is dispensed; and 2. Where such licenses, as specified in Subsection (B) of this Section, are held by restaurants whose business is conducted in one (1) room only and substantial quantities of food and merchandise other than intoxicating liquors are dispensed, then the licensee I9C L I E U TS~G 1 J92~00003\K03436M9DOC shall keep securely locked during the hours and on the days specified in this Section all refrigerators, cabinets, cases, boxes and taps from which intoxicating liquor is dispensed. C. A "closed place" is defined to mean a place where all doors are locked and where no patrons are in the place or about the premises. D. Any person violating any provision of this Section shall be subject to the penalties specified under Section 100.080 of the Code. E. Nothing in this Section shall be construed to prohibit the sale or delivery of any intoxicating liquor during any of the hours or on any of the days specified in this Section by a wholesaler licensed under the provisions of Section 311.180, R.S. Mo., to a person licensed to the sell the intoxicating liquor at retail. SECTION 600.340: SUNDAY OPERATION FOR SUNDAY SALES AND SUNDAY PACKAGE LIQUOR LICENSEES A. No person except holders of a Sunday sales license or Sunday package liquor license shall allow the service, sale or consumption of any alcoholic beverages on Sunday. B. Notwithstanding the provisions of Section 600.310 of this Code or any other law to the contrary, any person possessing a Sunday sales license under this Chapter may sell intoxicating liquor by the drink at retail for consumption on the premises between the hours of 9:00 A.M. on Sunday and midnight on Sunday. 1. If a person has a Sunday sales license as specified in Subsection (B) of this Section, his/hcr premises will remain a closed place, as defined in Subsection (C) of Section 600.310, betwcen the hours of 1:30 AM Stmday until 9:00 AM Sunday, and midnight Sunday until 6:00 AM Monday. C. Notwithstanding the provisions of Section 600.310 of this Code or any other law to the contrary, any person possessing a Sunday package liquor license under this Chapter may sell intoxicating liquor in the original package at retail between the hours of [11:00] 9:00 A.M. on Sunday and midnight on Sunday. D. Any person violating any provision of this Section shall be subject to the penalties specified under Section 100.080 of the Code. Section 2. The provisions of the Municipal Code of the City of Riverside, Missouri amended herein shall not be construed to revive any former ordinance, clause or provision of the Municipal Code of the City of Riverside, Missouri. Section 3. The sections, paragraphs, clauses, and phrases of the Ordinance are severable and if any portion of the Ordinance is declared unlawful by the valid judgment, decree, or injunction order of a court of competent jurisdiction, such ruling shall not affect any of the J `CLIHNTS'~G W93~00002`K03J3G89_DOC 2, J-~CIJPNTSV61492~000OZKU3d36R9.DOC remaining phrases, clauses, sentences, paragraphs, and sections of the Ordinance and all provisions of the Ordinance not specifically declared to be unlawful shall remain in full force and effect. Section 4. This ordinance overrides any conflicting provision or regulation within the Municipal Code of the City of Riverside, Missouri. Section 5. This ordinance shall take effect immediately.
