ORDINANCE NO. 2003-96
AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE
A SETTLEMENT AGREEMENT WITH AD TREND, INC.
WHEREAS, the City of Riverside, Missouri ("City") is a party to a court action entitled
Ciry of Riverside, Missouri v. Ad Trend, Inc., Case No. 99CC01950, in the Circuit Court of Platte
County, Missouri (the "Action").
WHEREAS, the City and Ad Trend, Inc. have reached an agreement for settlement of the
Action.
NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside,
Missouri, as follows:
Section 1. The City of Riverside shall enter into an agreement for settlement of the Action
whereby, among other provisions, the City shall allow Ad Trend to erect one (1) billboard at the
site which is the subject of the Action and in exchange both parties will dismiss the Action and
Ad Trend will post a bond for future construction of a road to the subject site and limit the
subject matter of the advertised material (the "Agreement").
Section 2. The execution and delivery of the Agreement is approved, and the Mayor is
authorized to execute the Agreement, to make such changes, additions, and deletions as may be
deemed necessary by the Mayor, and to take such other actions reasonably necessary to carry out
the intent of this Ordinance on behalf of the City, the execution of the Agreement being
conclusive evidence of such approval.
Section 3. This Ordinance shall be in full force and effect from and after its passage and
approval.
