HomeMy WebLinkAbout2003-098 - Amendment to Chapter 210 of the Municipal CodeBILL NO. 2003-98 ORDINANCE NO. 2003-98 AN ORDINANCE AMENDING TITLE II, CHAPTER 210 OF THE MUNICIPAL CODE OF THE CITY OF RIVERSIDE, MISSOURI, BY ADDING A NEW SECTION 210.325: DAMAGE, DESTRUCTION OR THEFT OF PUBLIC LIBRARY MATERIALS WHEREAS, the Revised Statutes of the State of Missouri (the "State"), Section 182.240, provides that the governing body of a city may pass ordinances imposing suitable penalties for the punishment of persons committing injury upon public library grounds or property, and for failure to return any book belonging to a public library; and WHEREAS, the City of Riverside, Missouri (the "City") and its staff have conducted a comprehensive review of the City's Municipal Code (the "Code") sections regarding Offenses Concerning Property and Fraud and believe that a specific prohibition against the theft of property and/or materials from public libraries in the City is not properly reflected in the current version of the Code; and WHEREAS, the City staff and the Board of Aldermen have reviewed, examined and deemed adoption of the amendment to be advisable and in the City's best interests for the promotion of the health, safety and welfare of the residents of the City; and NOW, THERFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri, as follows: Section 1. Section 210.325 of the Municipal Code of the City of Riverside, Missouri is hereby added to the City's Code, and shall read as follows: SECTION 210.325: DAMAGE, DESTRUCTION OR THEFT OF PUBLIC LIBRARY MATERIALS A. A person commits the offense of damage, destruction or theft of public library materials if he/she knowingly damages or destroys public library materials or appropriates public library materials with the purpose of permanently depriving a public library of such materials. B. For purposes of this Section, the term "public library materials" refers to any materials contained within a public library in the City available for use and/or check-out by library patrons, and includes, but is not limited to, books, magazines, newspapers, or other periodicals, phonograph records, videotapes, compact discs (CDs), digital video discs (DVDs), and electronic audio/video equipment. C. For purposes of this Section, the teen "public library" inchides any library facilities of public schools in the City. Section 2. The provisions of the Municipal Code of the City of Riverside, Missouri revised herein shall not be construed to revive any former ordinance, clause or provision of the Municipal Code of the City of Riverside, Missouri. Section 3. The sections, paragraphs, clauses, and phrases of the Ordinance are severable and if any portion of the Ordinance is declared unlawful by the valid judgment, decree, or injunction order of a court of competent jurisdiction, such ruling shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of the Ordinance and all provisions of the Ordinance not specifically declared to be unlawful shall remain in full force and effect. Section 4. This Ordinance overrides any conflicting provision or regulation within the Municipal Code of the City of Riverside, Missouri. Section 5. This ordinanc shall take effect immediately. ~ ~.
