ORDINANCE NO. 2003-99
AN ORDINANCE AMENDING CHAPTER 210 OF THE CITY CODE BY AMENDING
SECTION 210.530 REGARDING UNLAWFUL USE OF WEAPONS AND ADDING NEW
PROVISIONS PERTAINING TO FIREARMS IN CITY BUILDINGS, AND FIXING THE
TIME WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE
WHEREAS, the Missouri Legislature passed and adopted 2003 House Bill 349, and
overrode the Governor's veto of the same, allowing the carrying of concealed weapons in certain
places by individuals licensed and permitted to the do the same under a certain permitting
procedure, and such law shall take effect on October 11, 2003; and
WHEREAS, House Bill 349 provides an exception allowing municipalities to prohibit the
carrying of concealed weapons into government buildings; and
WHEREAS, the City staff and the Board of Aldermen have reviewed, examined and
deemed amendment of Section 2150.530 to be advisable and in the City's best interests for the
promotion of the health, safety and welfare of the residents of the City; and
WHEREAS, the City deems it advisable to harmonize, to the extent possible, its ordinances
with the statutes of the State.
NOW, THERFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri, as
follows:
Section 1. Section 210.530 of the Municipal Code of the City of Riverside, Missouri is hereby
amended, by adding Subsections E, F and G thereto, and such Subsections E, F, and G shall read as
follows:
E. Subparagraphs (1), (7) and (8) of Subsection (A) of this Section shall not apply to
any person who has a valid concealed carry endorsement issued pursuant to Missouri
Revised Statutes Section 571.094, or a valid permit or endorsement to carry
concealed firearms issued by another state or political subdivision of another state.
F. Subparagraphs (3), (4), (5), (6), (7) and (8) of Subsection (A) of this Section shall not
apply to persons who are engaged in a lawful act of defense pursuant to Missouri
Revised Statutes Section 563.031.
G. Firearms in City Buildings.
(1) No person who has been issued a concealed carry endorsement by the
Missouri director of revenue under Missouri Revised Statutes Section
571.094 or who has been issued a valid permit or endorsement to carry
concealed firearms issued by another state or political subdivision of another
state, shall, by authority of that endorsement or permit, be allowed to carry a
concealed firearm or to openly carry a firearm in any building or portion of a
building owned, leased or controlled by the City.
(2) Signs shall be posted at each entrance of a building entirely owned, leased or
controlled by the City stating that carrying of firearms is prohibited. Where
the City owns, leases or controls only a portion of a building, signs shall be
posted at each entrance to that portion of the building stating that carrying of
firearms is prohibited
(3) This Subsection (G) shall not apply to buildings used for public housing by
private persons, highways or rest areas, firing ranges, or private dwellings
owned, leased or controlled by the City.
(4) Any person violating this Subsection (G) may be denied entrance to the
building or ordered to leave the building. Any City employee violating this
Subsection (G) may be disciplined. No other penalty shall be imposed for a
violation of this Subsection (G).
(5) No person who has been issued a certificate of qualification which allows the
person to carry a concealed firearm before the Missouri director of revenue
begins issuing concealed carry endorsements in July, 2004, shall, by authority
of that certificate, be allowed to carry a concealed firearm or to openly carry
a firearm in any building or portion of a building owned, leased or controlled
by the City.
Section 2. The provisions of the Municipal Code of the City of Riverside, Missouri enacted or
amended herein shall not be construed to revive any former ordinance, clause or provision of the
Municipal Code of the City of Riverside, Missouri.
Section 3. The sections, paragraphs, clauses, and phrases of the Ordinance are severable and if
any portion of the Ordinance is declared unlawful by the valid judgment, decree, or injunction order
of a court of competent jurisdiction, such ruling shall not affect any of the remaining phrases,
clauses, sentences, paragraphs, and sections of the Ordinance and all provisions of the Ordinance
not specifically declared to be unlawful shall remain in full force and effect.
Section 4. This ordinance overrides any conflicting provision or regulation within the
Municipal Code of the City of Riverside, Missouri.
Section 5. This ordinance shall take effect on October 11, 2003, and shall be in full force and
effect from and thereafter.
