MINUTES OF REGULAR MEETING OF
BOARD OF ALDERMEN OF CITY OF RIVERSIDE, MISSOURI
NOVEMBER 17, 1992
A regular meeting of the Berard of Aldermen of the City
of Riverside, Missouri was held in the City Hall in
Riverside, Missouri on November 17, 1992, at 7:30 p. m. Those
present were Wedua, Teters, Karr and Ruleg Shepard and
Marshall absent. Mayor Betty Burch called said meeting to
order.
It was decided to dispense with the reading of the
minutes of October 20, November 3 and November 10 for the
present time.
Jae Marlow, 4436 N Agnes, Kansas Gity, Mo. presented
business license application for J C's Family Drive In
Restaurant at 4510 NW Gateway. This was approved subJect to
obtaining a sales tax number, Health Department's approval
and payment of the fee.
Anthony Orlando, 7410 Tower Court, Platte Woods,
Missouri 64151, presented a Special Use Perrnit and Business
License for the Singer Hall at 3@1 NW Business Park Lane. Mr.
Orlando said that the Binger Hall would be open on Friday,
Saturday, Sunday and Tuesday from 6:45 p. m. to 10:00 p. rn. A
separate person will operate the snack bar and there are
three different "Nat for Profit Organizations" to operate the
Hall.
Rule moved that the Special Use Permit far Jae Marlow be
approved, seconded by Karr, the vote was Wedua, Rule, Teters
and Karr, yes; Shepard and Marshall absent.
The Business License far Anthony Orlando far the rental
of the Binger Hall was approved slang with the Special Use
Permit subject to the payment of the fee.
Richard C. Hunter, 3425 Ba 1 es, K. C. , MO 64128 presented
business license application for the Binger Hall, d/b/a
Council for United Action tCUA>; Gilbert Thomas, 3132 Lister,
K.C., MO 64128, presented business license application far
the Binges Hall, d/b/a Kiwanis Mid-Town Club; and Eari A.
Kitts, Sr., 7524 Wabash, K.C., MO, presented business license
application for the Binges Hall, d/b/a Pioneer Incorporated
Club. The applications were being checked out by Chief Bob
Bayless and he will advise the Board of the outcome.
Philip Trautner, 2424 N. Purcell, Gladstone,
representing Heartland Service, presented business license
application to wash trucks at various locations in the City.
This matter was discussed. It was decided to table the
matter until the first of 1993 and would advise Mr. Troutner
of the outcome (his new address will be 401 South 42nd

Harland R. Russell, 89@9 Mohawk Road, Leawaad, KS 662@6,
presented business license application for Calar Ca. and
Midwest Surface Preparation at 4124 Riverside Street. This
is for wholesale only of paint. He said there will be no
mixing of paints. This material is received in containers.
This was approved subject to the payment of the fee.
Mr. Russell said the Midwest Surface Preparation Company
prepares items such as phone booths, doors, etc., stripping
them of paint for refinishing. There are na contaminates
from this process going into the sewers. The business
license application far Midwest Surface Preparation was
approved subject to the payment of the fee.
Mr. Russell also had an application far Metro North Taw
Service at same location. The Hoard advised him that since
this would require a special use permit, it would have to be
presented to the Planning Commission before the Hoard could
act on it.
Mr. Denis Hierman, 4413 NW 65th Street, presented
business 1'icense application for Mid-West Performance
Hosts, Inc., 5@@ NW Parkway (Storage of Haats) and also a
Special Use Permit was presented. The Hoard advised Mr.
Hierman that he would have to appear before the Planning
Commission for approval before coming to the Hoard.
Gene Estes, 23375 Highway EE, Dearborn, MO presented
business license application for Hubba+s Bar-H-Q Grill at
2642 West Platte Road. This was approved subject to
obtaining a sales tax number, Health Department's approval
and Payment of the fee.
Mr. and Mrs. Mark W i nt ermut e, 44@8 I nd i an Lane, were
asked to be present to discuss their fence which is on the
Cityrs right of way. Mr. Wintermute explained to the Mayor
and Hoard that prior to the fence being installed, there were
many people driving and turning around in his yard and one of
his children almost was run over by a truck. He said mast of
the traffic is from the construction going on. He said even
after the fence was installed, several vehicles have run into
the fence. He explained that none of the neighbors have any
ob~ectian to the fence; that the fence was in for thirteen
months before he received any complaints from the City. He
said his application for the fence was presented to the
Planning Commission by George Flaws, due to his work hours.
The Planning Commission did approve the plan. Fred
Welkin, Zoning Enforcement Officer, was not advised of
this fence plan, prior to its going to the Planning
Commission. This matter was discussed and it was decided

that the Board of Aldermen look at the fence and report back
on December 1, 1992. The Winterrnutes will be advised of the
outcome.
Barbara Murphy, 4929 NW Gateway #16, was requested to be
present at the meeting to discuss the letter she received
from the City regarding her delinquent payment of sales tax.
According to Ma. R. S. 144.032 the City of Riverside is
required to revoke the business license of any business
delinquent on sales tax. Ms. Murphy said that she is
delinquent far the first two quarters in 1992 and same in
1991. She is making payments and feels she will be able to
catch up an the back payments if given same time. The Board
said they would allow same time, but needs documentation from
Ms. Murphy as to her intention of making payments. Upon this
documentation, the Berard would be willing to allow 90 days.
Rule moved that Ms. Murphy be allowed 90 days within
which to pay the delinquent sales tax upon documentation from
her that she will der sa, seconded by Karr, the vote was Rule,
Karr, Teters, and Wedua, yes; Shepard and Marshall absent.
Wes Seyller, 5804 N. Kensington, Kansas City, Ma, d/b/a
MOKAN Container Co., spoke to the Mayor and Berard far
permission to stack the containers four high. He said that
he would not stack any mare than two high slang his property
fence and on the front of the property. He would stagger the
containers, two at property line, then three and then four
high. This matter was discussed. Mayor Burch said she would
review the minutes when Mr. Seyller first obtained his
business license and also the Board would look at the ones
stacked four high near Highway 435. He will be advised of
the outcome.
A recess was called. Meeting reconvened. The roll was
called and Aldermen Wedua, Teters, Karr and Rule were present
and Shepard and Marshall absent. Mayor Burch presided over
the remainder of meeting.
The minutes of October 20, 1992 were approved as read.
The minutes of November 3, 1992, were read and approved
as corrected.
The minutes of November 10, 1992, were read and approved
as corrected.
City Clerk Grace Kemerling reported that the Municipal
Court Clerks reports far September and Detaber 1992 were on
her desk an November 12, 1992.
Karr moved that Bill Na. 92-63 be placed an its first

reading, said Hill provides for the payment of certain
indebtedness as listed therein, seconded by Rule, the vote
was Wedua, Teters, Karr, and Rule, aye; Shepard and Marshall
absent.
Karr moved that Hill No. 92-63 be placed on its second
reading, seconded by Wed u, the vote was Wedua, Teters, Karr
and Rule, aye; Shepard and Marshall absent. Whereupon, the
Hill having been made available for public inspection prior
to the consideration of the Hoard of Aldermen, Hill No. 92-62
was passed.
A "Thank You" card was received from Jackie Downey far
the moral support and flowers on the death of her son.
Mayor Burch said that she had Fred Wilken to go aver the
past building permits to check on the permits not completed.
It appeared Mr. Edgel has done nothing to his house which had
burned in April, 1991 and Roger Edmonds has not had his
septic tank filled as required. It was suggested that these
people be required to complete the projects and if not, they
will have to be brought to court.
On November 12, 1992, the Planning Commission approved
the Quindaro Hend Study Area on that property South of HN
Railroad Tracks and passed this on to the Hoard for its
approval. The Board discussed this matter and would like to
accept this study.
Karr moved that Hill No. 92-64 be placed an its first
reading, said Hill accepts the Quindaro Hend Study Area,
seconded by Wedua, the vote was Teters, Rule, Wedua and Karr
voted aye; Shepard and Marshall absent.
Karr moved that Bill No. 92-64 be placed on its second
reading, seconded by Wedua, the vote was Teters, Rule, Wedua,
and Karr, aye; Shepard and Marshall absent. Whereupon, the
Hill having been made available far public inspection prior
to the consideration of the Hoard of Aldermen, Hill No. 92-64
was passed.
Rule moved that Bill No. 92-65 be placed an its first
reading, said Bill provides for the discontinuance of the
moratorium on building in the area south of HN Railroad
Tracks and East of I635, seconded by Karr the vote was,
Wedua, Teters, Karr and Rule, aye; Shepard and Marshall
absent.
Karr moved that Hill No. 92-65 be placed on its second
reading, seconded by Wedua, the vote was, Wedua, Teters, Karr
and Rule, aye; Shepard and Marshall absent. Whereupon, the
Hill having been made available far public inspection prior

to the consideration of the Board of Aldermen, Bill No. 92-
65 was passed.
It was announced the Christmas in the Park will be two
weeks from today, December 1, 1992.
Karr moved that the City purchase a 1990 Cat Backhoe for
#20,500, seconded by Teters, the vote was Teters, Karr and
Wedua, yes; Rule, no; Shepard and Marshall absent.
Wedua is to get bids on the repair of the hales in
Mattox Raad.
Mayor Burch said she went to a meeting with the Kansas
City Water Poliutian Department (Mr. Kenny Burkhead>
requesting the payment of X134,000 far one half of the sewer
line which they said they would pay. However, she was told
the City would have to negotiate the Reciprocal Sewer
Agreement and wanted to tie this Reciprocal Agreement to
the payment and were not going to make the X134,000 payment
until the City negotiated the Reciprocal Agreement. It was
brought out that when the original agreement was made for
the sewer construction, the Reciprocal Agreement was not
made a part of the agreement. Mayor Burch said she will da
further work in securing the X134,000.
Chief Bayless said that the City Employees are invited
to loin they in a caroling session on December 17, 1992 at
5:30 p. m. The peop 1 e w i 11 meet at C i t y Ha 11 at 5:30 p. m. and
from there will be transported by a hay wagon and after about
one and one half hours they are invited to his house for
refreshments.
A discussion was had concerning Jim Baughman's surgery
and tentative time he will be off duty.
There being no further business to came before the
Board, upon motion duly made, seconded and passed, meeting
ad~aurned at 10:43 p. m.
