AN ORDINANCE AMENDING SECTION 300.8 OF THE EMPLOYEE
HANDBOOK CONCERNING COMPENSATING TIME OFF FOR PUBLIC
SAFETY EMPLOYEES
WHEREAS, the Fair Labor Standards Act provides different rules for public
safety employees concerning overtime and compensatory time off; and
WHEREAS, it is necessary to amend the Employee Handbook to provide for
these differences;
NOW THEREFORE BE IT ORDAINED BY THE BOARD OF
ALDERMEN OF THE CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS:
(1) Section 300.8 of Riverside Employee Handbook: is deleted and a new Section
300.8 is enacted to read as follows:
300.8 Overtime Pay and Compensatory Time Off Non-Exempt:
Except for public safety Employees, Non-Exempt Employees shall be paid at
the rate of one and one-half (1 ''/2) times their Pay Rate for Hours Worked in
excess of forty (40) hours in a Standard Work Week, or receive compensatory
time off at the rate of one and one-half (1 '/2) compensatory hours for every
Hour Worked in excess of forty (40) hours in a Standard Work Week. The
City reserves the right to grant compensatory time off in lieu of overtime pay,
and any compensatory time off must first be approved by an Employee's
Department Head. Public Safety Employees will be compensated with
overtime pay, or compensatory time off, according to the FLSA and its
implementing regulations.
Hours Worked must first be authorized by a Department Head or the City
Administrator. Department Heads, or other supervising personnel, may
require Employees to work hours in excess of the Standard Work Week, and
Employees shall not, without sufficient cause, refuse to work, or fail to work
as scheduled. Without specific authorization from a Department Head or the
City Administrator, Employees are not authorized to perform any work before,
or after, their schedules shifts, or remain at their work stations before or after
the Standard Work Day. Compensatory time off shall not be allowed to
accumulate in excess of one hundred and twenty (120) hours. As an overtime
control measure and in accordance with the provisions of the Fair Labor
Standards Act Public Safety employees can accumulate up to 480 hours of
compensatory time, however the accumulated level must be reduced to
120 hours by the end of the given calendar year. Unused compensatory
time can be carried over into the next calendar year. The City need not make
compensatory time available to all Employees. Likewise, when the City
makes compensatory time off arrangements with individual Employees, the
agreements need not be the same for all Employees.
(2) This ordinance shall be in full force and effect immediately upon passage.
ADOPTED AND APPROVED by the Board of Aldermen and Mayor of the City of
