AN ORDINANCE A~IF.ND[NG TITLE [I OF THE MUNIC[PAL CODE OF THE
CITE' OF RIVERSIDE, MISSOUKI, BY ADDING SECTION 210.315
REGARDING THE CRIME OF THEFT OF MOTOR FUEL
WHEREAS. the Missouri Legislature has adopted a bill and signed such into law which
creates the specific crime of Theft of Motor Fuel and provides specific penalties for the same.
WHEREAS. the City Code includes provisions which prohibit certain activities and
transactions, and makes en~~a~~in~~ in the same a crime. related to theft of property and fraud.
WHEREAS. the Board of Aldermen and the City wishes to protect the public health. safety
and welfare of its citizens by adopting City Cude provisions similar to that provided in the State stance
described above.
NOW, THEREFORE, QE IT ORDA[NEll, By the Board of Aldermen of the City of
Ri~~erside. Missouri, as follows:
Section 1. The Municipal Code of the City of Riverside. Chapter 210. Article VI is hereb~~ amended
by the addition of Section ? 10.31 ~: Theft of :Motor Fuel, which Section shall read as follows:
SECTION 210.315: THEFT OF MOTOR FUEL
~Io person shall drive a motor vehicle so as to cause it to leave the premises of an establishment
at which motor fuel offered fur retail sale was dispensed into the fuel tank of such motor
chicle unless payment or authorized char~,e for motor fuel dispensed has been made. :A person
found guilty or pleading guilty to stealing pursuant to this Section. for the theft of motor fuel.
shall submit information regarding all of his or her operator's and chauffeurs licenses to die
court upon conviction and the court shall forward all information regarding such dri~er~
licenses and the order to the department of revenue for administration of such order and
suspension of the drivers license pursuant to the provisions of Section 302.236. RS~[o.
Section ?. The sections, paragraphs. clauses, and phrases of this chapter are severable and if~ any
phrase, clause. sentence, paragraph, or section of this Chapter shall be declared unlawful b~° the valid
judgement. decree, or injunction order of a court of competent jurisdiction. such rulin« shall not all~ct
any of the remaining phrases. clauses, sentences, paragraphs, and sections of this Chapter. hi the event
ghat, contrary to the policies, interests_ and values of the City, a court of competent jurisdictio^ issue, a
judgement, decree. or injunction order that this Chapter is unlawful because of any omission ur
prohibition in this Chapter, than all provisions of dais Chapter not specifically declared to be unla~~fui
shall remain in full force and effect. In the e~~ent duct ajudgement, decree or injunction order declarin~_
all or a portion of this Chapter to be w~lawful is reversed or vacated by a court of competent
jurisdiction, the provisions contained in this Chapter shall remain in full force and effect.
Section ~. fhis Ordinance shall be in full force and effect h~om and alter its passage and approval.
