RIVERSIDE, MISSOURI, BY ADUING SECTION 210.625 RF,GARDING
THE SALE OF METHAMPHETA_~~IINE PREC~~RSOR URUGS
WHEREAS. the Missouri Legislature has adopted a bill and signed such into law which
prohibits the sale of certain over-the-counter dross which have been identified as precursors to. or
common in~aredients in. the production of methamphetamine.
WHEREAS, the City Code includes provisions which prohibit certain activities and
transactions related to drugs and alcohol.
WHEREAS. the Board of Aldermen and the Cite wishes to protect the public health. safet~~
and welfare of its citirens by adopting City Code provisions similar to that provided in the state statute
described above.
NOW, THEKEFORE, BE [T ORllAINF.D_ B~~ the Board of _~Idermen of the Cit}~ of
EZiverside, Missouri. as follows:
Section 1. the Municipal Code of the City of Riverside, Chapter 210, Article XI is hereby amended
b~~ the addition of Section 210.62: Prohibited Sales of Precursor Drugs, which section shall read as
follows:
SECTION 210.625: PROHIBITEll SALES OE PRECURSOR DRUGS
:~. Prohihi~ion on Soles.
1. No person shall deliver in any sin<~le o~~er-the-counter sale more than three (=1
packa~zes of any methamphetamine precursor drug or any combination of
methamphetamine precursor drugs.
?. For purposes of this Section. "methamphetamine precursor dnig~~ shall mean any
drug containing ephedrine. pscudocphedrine, phenylpropanolamine, or any of
their salts, optical isomers. ur salts of optical isomers.
;. This Section shall not appl}~ to any product labeled pursuant to federal regulation
for use only in children under t~~elve years of age. or to an}~ products that the
state department of health. upon application of a manufacturer, exempts by rule
from this Section because the product has been formulated in such a way as to
effectively prevent the comcrsion of the actin-e in~~redient into
methamphetamine, or its salts or precursors.

>ale who ~~iolates subsection 1 of this subsection :A shall not be penalized
pursuant to this Section if such person documents that an employee trainin~~
program eras in place to provide the employee with information on the state and
federal regulations regarding ephedrine, pseudoephedrinc. or
phenvipropanolamine.
~. Anc person ~~ho knowingly or reclaessly violates this section is ~~uilt~~ of a
misdemeanor.
B. Limn ~~n Kea~il .Soles. The retail sale of methamphetamine precursor drugs shall be
limited to:
1. Sales in packages containing not more than a total of three (3) «rams of one or
more methamphetamine precursor drugs. calculated in terms of ephedrine base.
pseudocphedrine base and phenylpropanolaminc base: and
?. For nonliquid products, sales in blister packs. each blister pack containing not
more than t~ti~o (?) dosage units. oc where the use of blister packs is technically
infeasible, sales in unit dose packets or pouches.
;. Anv person holding a retail sales license pursuant to chapter l~-l. RS~to. ~~~ho
knowingly violates subsection 1 of this subsection B is guilty of a misdemeanor.
Section 2. ~fhe sections, paragraphs. clauses, and phrases of this chapter are severable and if any
phrase. clause, sentence, paragraph, or section of this Chapter shall be declared unlawful by the valid
judgement. decree. or injuncCion order of a court of competent jtiu~isdiction, such rulin~~ shall not aflect
any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Chapter. fn the c~ cut
that, contrary to the policies. interests. and values of the City, a court of competent jurisdiction issues a
judgement. decree, or injunction order that this Chapter is unlawful because of any omission or
prohibition in this Chapter. than all provisions of this Chapter not specifically declared to he unlawhil
shall remain in full force and effect In the event that a judgement. decree or injunction order declaring
all or a portion of this Chapter to be unlawftd is reversed or vacated by a court oY competent
jurisdiction. the provisions contained in this Chapter shall remain in full force and effect.
Section 3. This Ordinance shall be in full force and effect from and after its passage and approval.
