ORDWANCE NO. 200°-84
AN ORDINANCE APPROVING AND AUTHORIZING THE ACQUISITION OF
CERTAIN LANDS AND ALL ASSOCIATED APPURTENANCES ANll
IMPROVEMENTS BY THE CITY AND APPROVING ACTIONS
AND DOCUMENTS RELATED THERETO
WHEREAS, the City has approved the Gateway Redevelopment Plan (the "Plan") to
redevelop the Redevelopment Area (as defined in the Plan); and
WHEREAS, the City is authorized, pursuant to the Real Property Tax Increment Finance
Allocation Redevelopment Act, RSMo. Section 99.800 et seq., and the Plan, to acquire property
to achieve the objectives of the Plan; and
WHEREAS, the City desires to acquire certain real property, generally known as 4601
NW Gateway and legally described at Exhibit A hereto (the "Property"), which is necessary to
accomplish the goals and objectives of the Plan; and
WHEREAS, the City, as required by the Plan, has engaged an independent third party
MAI appraiser to prepare an appraisal of the Property; and
WHEREAS, the City desires to attempt to reach an agreement for the purchase of the
Property through the extension of an offer Co purchase the Property as hereafter provided;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN FOR
THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS:
Section 1. This Ordinance and the acquisition of the Properly is intended and is hereby
determined and declared to be necessary to accomplish, serve and achieve the objectives of the
Plan.
Section 2. An offer in the amount of Three Hundred Thrcc 1~housand and 00/100 Dollars
(5303,000.00) (the "Offer"), which Offer is in excess of the amount of the appraisal made by the
independent third party MAI appraiser engaged by the City to appraise the Property, to acquire
d~c fcc ownership interest in the Property by negotiation is hereby approved.
Section 3. The City shall engage in good faith negotiations, including the extension of
the Offer, for al least thirty (30) days.
Section 4. The Mayor, the City Administrator, the City Attorney and other appropriate
City officials are authorized to take any and all actions as may be deemed necessary or desirable
to cant' out and comply with the intent of this Ordinance and to execute and deliver for and on
behalf of the City the offer and a contract for purchase, as well as all certificates, instruments,
agreements and other documents, as may be necessary or desirable to effectuate the intent of this
Ordinance.
Section 5. This Ordinance shall be in full force and effect from and after its passage and
approval.
