HomeMy WebLinkAbout2002-090 - Real Estate Purchase Option AgreementBILL NO. 2002-90 ORDINANCE NO. 2002-90 AN ORDINANCE AUTHORIZING THE EXECUTION OF A REAL ESTATE PURCHASE OPTION AGREEMENT FOR THE POSSIBLE PURCHASE BY THE CITY OF PROPERTY FOR USE AS WETLANDS WHEREAS, the City of Riverside, Missouri ("City") has engaged in negotiations to purchase an option to purchase certain property from Bill Mann in order to satisfy its wetlands mitigation duties arising from development of certain properties; and WHEREAS, the City has reached an agreement whereby it will have an option to purchase certain property legally described on Exhibit A to the attached Agreement (the "Wetlands Property"); NOW, THEREFORE, he it ordained by the Board of Aldermen of the City of Riverside, Missouri, as follows: Section 1. The City of Riverside shall enter into an option agreement (the "Agreement") whereby in exchange for five thousand and no/100 dollars ($5,000.00), the City shall have the right, for a period of five years, to purchase all or portions of the Wetlands Property for $4500.00 per acre. Section 2. The execution and delivery of the Agreement, in substantially the form attached hereto as Exhibit A, is approved, the Mayor is authorized to execute the Agreement and to take such other actions reasonably necessary to carry out the intent of this Ordinance on behalf of the City, the execution of the Agreement being conclusive evidence of such approval. Section 3. This Ordinance shall be in full force and effect from and after its passage and approval.
