HomeMy WebLinkAbout2002-096 - Addition of Section 440.117 to the Municipal CodeBILL NO. 2002-96 ORDINANCE NO. 2002-96 AN ORDINANCE AMENDING CHAPTER 440, ARTICLE II OF THE RIVERSIDE CITY CODE BY ADDING SECTION 440.117 REGARDING USE OF MODULAR UNITS AS TEMPORARY BUILDINGS FOR COMMERCIAL OR INDUSTRIAL USE AND REQUIRING A SPECIAL USE PERMIT FOR THE SAMF, WHEREAS, the City of Riverside, Missouri is charged with protecting the public, health, safety and welfare, and desires to do so fairly and responsibly. WHEREAS, Missouri statute sections 89.010 et al. authorize the City to regulate and restrict the erection, construction, reconstruction, alteration or use of buildings, structures, or land in its zoning disp~icts, in order to, among other things, secure safety from fire, panic and other dangers; to promote health and the general welfare; to prevent the overcrowding of land; to avoid undue concentration of population; to preserve features of historical significance; and to facilitate the adequate provision of transportation, water, sewerage, schools, parks, and other public requirements. WHEREAS, the City desires to implement mechanisms intended to attract commercial investment and business, and to increase the property values of current property owners. WHEREAS, the City desires to promulgate regulations regarding the use of modular units as temporary locations for businesses in commercial districts. WHEREAS, the Planning and Zoning Commission of Riverside, Missouri (the "Commission"), at a meeting on August 22, 2002, held a public hearing regarding, and considered, a proposal initiated by the City to require special use permits for modular units to be used as described above; and WHEREAS, the Commission, subsequent to the public hearing on the proposal described above, recommended approval of the proposal, on August 22, 2002; and WHEREAS, the Board of Aldermen of the City of Riverside, Missouri, held a public hearing regarding, and considered, the above proposal and the above recommendation of the Commission, at its meeting on August 27, 2002. NOW, THEREFORE, be it ordained by the Board of Aldermen of Riverside, Missouri, as follows: Section 1. The following Section 440.117, titled "Modular Units as Temporary Facilities," shall be added to Title V, Chapter 440 of the city code of the City of Riverside, Missouri, which Section shall read as follows: SECTION 440.117: MODULAR UNITS AS TEMPORARY FACILITIES A. Modular Unit, Defi~ied. For purposes of this Section 440.1]7 only, the term Modular Unil shall mean a transportable building unit designed to be used by itself 9. The site plan shall delineate the gross floor area of the building or structure. 10. The site plan shall describe the landscaping to be provided. 11. The site plan shall delineate the proposed exterior lighting. 12. The site plan shall delineate the proposed architectural details of the facility. 13. The site plan shall indicate the proposed signage. 14. The site plan shall set forth any other information necessary for determination of the suitability of the proposed use for the site. E. Review and Expiration. All special use permits issued pursuant to this Section shall be reviewed annually by the Board of Aldermen, and shall automatically expire and be of no effect on the second (2nd) anniversary of the issuance of such special use permit. Nothing in the Section shall prohibit the holder of an expired special use permit from applying for another special use permit for the same facility and the same commercial or industrial use, provided that such application must be made to the Planning Commission and the Board of Aldermen. Section 2. If any section, subsection, subdivision, paragraph, sentence, clause or phrase in this ordinance, or the application thereof to any circumstances, is for any reason held to be unconstitutional or invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this ordinance. Section 3. This Ordinance shall become effective immediately upon final passage and approval by the Mayor.
