ORDINANCE NO. 2002-97
AN ORDINANCE AUTHORIZING THE EXECUTION OF THE
INTERGOVERNMENTAL EMERGENCY AID AGREEMENT BETWEEN THE CITY
OF RIVF,RSIDE, MISSOURI AND PLATTE COUNTY, MISSOURI
WHEREAS, the City of Riverside, Missouri ("City") has engaged in negotiations with
the county government of Platte County, Missouri (the "County") regarding the provision of
mutual aid by the County in emergency situations or conditions; and
WHEREAS, the City has reached an agreement whereby it will be provided such aid and
in return will reimburse the County its costs related to the provision of such aid.
NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside,
Missouri, as follows:
Section 1. The Cite of Riverside shall enter into an agreement whereby it will receive aid from
the County in emergency conditions or situations stemming from a natural disaster and further
whereby it will reimburse the County for its costs related to the provision of such aid (the
"Agreement").
Section 2. The execution and delivery of the Agreement, in substantially the form attached
hereto as Exhibit A, is approved, the Mayor is authorized Co execute the Agreement and to take
such other actions reasonably necessary to carry out the intent of this Ordinance on behalf of the
City, the execution of the Agreement being conclusive evidence of such approval.
Section 3. This Ordinance shall be in full force and effect from and after its passage and
approval.

WI~REAS, 11Tissouri law authorizes local governments to contract with each other to
provide services, including the provision of nuttual aid under emergency conditions; and
WI~ItEA5, Nfiesouri law and state policy also provides for certain reimbursements or
fina~ocial aid to local government for certain natural disasters or emergency conditions declared
by the Governor, and
WHERPAS, COUNTY Salo it to be in its best imereat to have such mutual aid
agr~eemems with other local governmental bodies in the state and region.
NOW, 'I'HF.REFORE, in consideration of the mutual covenants and agreements set forth
herein, the parties hereto agree as follows:
COUNTY hereby agrees to provide through its Director of Public Works
such mutual aid as may be requested by CITY pursuant to emetgetuy conditions of a natural
disaster as de&ied by 11Tssouxi law. The aid rendered shall be to the extent of available
personnel and equipment not required for minimum needs of COUNTY. The judgment of the
Director of Public Works or his designed shall be Sn~al as to the personnel sad equipmerrt so
available.
2. Personnel dispatched to aid CITY shall remain employees of COUNTY,
but shall work under the supervision of the Director of Public Works of CITY. COUNTY
retains the right to withdraw airy and all aid rendered upon direction of the COUNT'Y' Director of
Public Works.
3. The Director of Public VPorks will provide a list of hourly rates and
equipment costs, and hours worked for all such aid rendered to CITY for aQ actual wets, and
CITY agrees to compensate such claim for costa incurred as expeditiously as possible.
4. COUNTY will maiataia workers comp~sation coverage for its employees
and liability coverage for its vehicles and equipment. Any uninsured or extraordinary expenses
may be a part of claimed costs for reimbursement. CITY agrees to maintain adequate liability
insurance under state law and to hold harmless and indemnify COUNTY for any and all claims
occurring while its personnel sad equipment are working under the direction of the Director of
Public Works of CITY. These indemnities shall include attorney's fees and costs that may arise
from providing aid pursuant to this A.greemem.
5. The purpose of these recitals is to insure that COUNTY is reimbursed sIl
costs and assumes no additional liabilities as a result of this Agreement. Neither party to this
Agreement shall be liable for its failure or refusal to render aid pursuant to this Agreement. The
Director of Public Works, or his designee in charge of operations, shall in his sole discretion
determine the mamner in which such emergenry aid may be used.
IN WITNESS WHEREOF, the parties hereto h9,ve caused this Agreement to be executed
is duplicate by their respective representatives, thereunto duly authorized, as of the day and year
set forth below.
