HomeMy WebLinkAbout2002-106 - Amendments to Section 440.115 of the Municipal CodeBILL NO. 2002-106 ORDINANCE NO. 2002-106 AN ORDINANCE AMENDING ARTICLE II, SECTION 440.ll5(B) OF THE RIVERSIDE CITY CODE REGARDING THE SPECIAL USE PERMIT REGULATIONS AND REQUIREMENTS APPLICABLE TO ADULT ENTERTAINMENT BUSINESSES WHEREAS, certain conduct occurring on premises offering adult entertainment may be detrimental to the public health, safety and general welfare of the citizens of the City, and, therefore, such conduct must be regulated; and WHEREAS, rcgulation of the adult entertainment industry is necessary because in the absence of such regulation significant criminal activity has historically and regularly occurred; and WHEREAS, one of the secondary affects of adult entertainment businesses has been decreased property values in surrounding areas; and WHEREAS, businesses providing adult entertainment are increasingly associated with ongoing prostitution, sexual solicitation, disruptive conduct and other criminal activity which is currently not subject to effective rcgulation and which constitutes an immediate threat to the public peace, health and safety; and WHEREAS, regulation of the adult entertainment industry is necessary to deter prostitution or high-risk sexual conduct that may be associated with adult entertainment Facilities and to limit the health hazards of syphilis, gonorrhea, herpes, hepatitis-B and HIV/AIDS that may result. NOW, THEREFORE, be it ordained by the Board of Aldermen of Riverside, Missouri, as follows: Section 1. The Following Section 440.115(B) is hereby amended and shall hereafter read, in its entirety, as follows: SECTION 440.115: ADULT ENTERTAINMENT BUSINESSES A. ... B. Approved Locations. Adult businesses are permitted by special use permit only in districts zoned "P' which are not a designated portion of a GP-General Planned llevelopment District, as depicted on the map attached hereto. Adult businesses located in a dish•ict zoned "P' must also comply in full with the Special Conditions described in subsection C below and the Requirements described in subsection D below. Adult businesses shall not be located in any dish-icls or areas other than that specifically delineated in this subsection B. C. ... Section 2. If any section, subsection, subdivision, paragraph, sentence, clause or phrase in this ordinance, or the application thereof to any circumstances, is for any reason held to be unconstitutional or invalid or ineffective by any courC of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this ordinance. Section 3. This Ordinance shall become effective immediately upon final passage and approval by the Mayor. Passed this 3`d day of September, 2002.
