HomeMy WebLinkAbout2002-107 Amending Section 410.088 of City Code Regarding Sideyard Setback Requirements in Districts Zoned CPOBILL NO. 2002-107 ORDINANCE NO. 2002-107 AN ORDINANCE AMENDING THE RIVERSIDE CITY CODE BY AMENDING SECTION 410.088(F)(2) REGARDING SIDEYARD SETBACK REQUIREMENTS IN DISTRICTS ZONED CPO WHEREAS, the City of Riverside, Missouri is charged with protecting the public, health, safety and welfare, and desires to do so fairly and responsibly: and WHEREAS, the City desired to implement zoning mechanisms intended to attract commercial investment and business, and to increase the property values of current property owners; and WHEREAS, The City's Board of Aldermen, subsequent to a public hearing, at its June 18, 2002 meeting, promulgated and adopted a zoning district which promotes the development of professional offices, civic uses and accessory supporting uses in an area which is destination oriented known as the "CPO" Civic and Professional Office District; and WHEREAS, the City now desires to make an adjustment to the regulations and restrictions enforced in the CPO District, NOW, THEREFORE, be it ordained by the Board of Aldermen of the City of Riverside, Missouri, as follows: Section 1. Section 410.088(F)(2) of the Municipal Code of the City of Riverside is hereby amended and shall read, in its entirety, as follows: SECTION 410.088: "CPO" CIVIC AND PROFESSIONAL OFFICE DISTRICT F. Building Form and Use. 1. ... 2. Setbacks. Building setbacks shall be as follows: (a) Front yard. The depth of the front yard shall be at least ten (10) feet from the front lot line. (b) Side yard. There shall be a side yard on each side of a building not less than ten (10) feet from the side lot line, provided that for each story greater than one (l), an additional five (5) feet shall be required to a maximum of twenty five (25) feet. (c) Rear yard. The depth of the rear yard shall be at least twenty (20) feet from the rear lot line. (d) Setback from Street. A minimum building setback of ten (10) feet is required from any street. Section 2. This ordinance shall take effect immediately. Section 3. If any section, subsection, subdivision, paragraph, sentence, clause or phrase in this Ordinance, or the application thereof to any circumstances, is for any reason held to be unconstitutional or invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this Ordinance.
