ORDINANCE NO. 2001-47
AN ORDINANCE PLACING A TEMPORARY MORATORIUM ON THE
SUBMISSION AND CONSIDERATION OF REZONING APPLICATIONS AND
CERTAIN BUILDING PERMIT AND DEVELOPMENT APPLICATIONS
WITHIN THE PROPOSED REDEVELOPMENT AREA UNDER THE PROPOSED
GATEWAY REDEVELOPMENT PLAN
WHEREAS, the City is considering the adoption of the Gateway Redevelopment Plan
("Redevelopment Plan"), to provide for the redevelopment of the area identified on the attached
Exhibit A ("Redevelopment Area").
WHEREAS, the City also desires to consider a master development plan for the
Redevelopment Area which will examine development potential and highest and best use as well as
infrastructure issues ("Master Development Plan").
WHEREAS, in order to study and refine these issues and consider the development of a
Master Development Plan, the adoption of a Master Development Plan, and the adoption of the
Redevelopment Plan, the City desires to place a temporary moratorium on the submission,
consideration and approval of (i) rezoning applications and (ii) building permit and development
applications related to new development of property within the Redevelopment Area. New
development does not include the expansion of an existing operating business on such property but
rather means development of property unrelated to such actual and proper business use now existing
on such property.
NOW, THEREFORE, be it ordained by the Board of Aldermen of Riverside, Missouri:
Section 1. Tvo applications for rezoning, including planned districts, within the Redevelopment
Area or building permit or development applications related to new development of property
within the Redevelopment Area will be accepted or considered by the City until the earlier of
(i) 120 days after the date of the passage of this Ordinance or (ii) the adoption of the Master
Development Plan and/or the Redevelopment Plan. After the moratorium has ended, the
submission, consideration and approval of such applications shall be in conformity with any
and all ordinances then in effect, including the Master Development Plan and the
Redevelopment Plan.
Section 2. This ordinance shall take effect immediately.
