AN ORDINANCE AUTHORIZING AND APPROVING THE CITY OF RIVERSIDE,
MISSOURI TO ACQUIRE THE LAND AND IMPROVEMENTS COMMONLY
KNOWN AS THE TRILLIUM LAND BY PAYING CONDEMNATION DAMAGES
INTO THE CIRCUIT COURT
WHEREAS, the City is authorized to acquire property through eminent domain
proceedings; and
WHEREAS, the City desires to so acquire the real property described at Exhibit A (the
"Property"); and
WHEREAS, the City has been authorized by an Order of the Platte County, Missouri
Circuit Court (the "Court") to acquire the Property; and
WHEREAS, the Commissioners appointed by the Court to assess the damages resulting
in the City's condemnation proceedings have determined the amount of damages for such
condemnation; and
WHEREAS, Missouri Statutes require the City to pay the condemnation damages to the
Clerk of the Court,
NOW, THEREFORE, BE IT ORDAINED by the Board of Aldermen of Riverside,
Missouri:
Section 1. This ordinance is intended and is hereby determined and declared to be
necessary to accomplish and serve the purposes of the City in acquiring the Property.
Section 2. The City shall pay, pursuant to the Report of Commissioners of March 5,
2001, Three Million Eighty Nine Thousand Four Hundred Thirty and NO/100 Dollars
($3,089,430.00) in damages for the condemnation of the Property, together with costs as
approved by Order of the Court.
Section 3. The City Clerk is hereby authorized and approved and shall pay to the
Clerk of the Circuit Court of Platte County, Missouri that amount described in Section 2 above.
Section 4. The Mayor, the City Administrator, the City Attorney and other
appropriate City officials are hereby authorized to take any and all actions as may be deemed
necessary or convenient to carry out and comply with the intent of this Ordinance and to execute
and deliver for and on behalf of the City all instruments, agreements and other documents, as
may be necessary or convenient to perform the matters herein authorized and contemplated.
Section 5. This Ordinance shall be in full force and effect from and after its passage
and approval.
