MINUTES OF REGULAR MEETING OF BOARD OF ALDERMEN OF
CITY OF RIVERSIDE, MISSOURI
DECEMBER 18, 1990
A regular meeting of the Board of Aldermen of the City of
Riverside, Missouri was held in the City Hall in Riverside,
Missouri on December 18, 1990, at 7:30 p.m. Those present were
Aldermen Marshall, Teters, Karr, Shepard and Rule, Richardson
absent and Mayor Betty Burch called said meeting to order.
It was decided to dispense with the reading of the minutes
of December 4, 1990 for the present time.
Jeff Gilliam, 626 Mills Lane, Irving, Texas 75062,
Customer Service Rep. in charge of setting up new operations
for Marpax, Ink Co. presented a business license application at
626 NW Platte Valley Drive. This is for a warehouse and
distribution center for ink. Their main office is in
Sacramento, California. They will start operation at this
location around the middle of January 1991. The business
license was approved subject to the payment of the fee.
Mark Jansen, 4600 N.W. 52nd, Kansas city, MO presented a
Special Use Application, Building Plans and Business License
Chevy Duty Parts, Inc. at 4319 N.W. Gateway. This is an
operation for special order of parts for the restoration of
antique vehicles.
Karr moved that the Special Use Application be approved
for Chevy Duty Parts, Inc., seconded by Marshall, the vote was
Marshall, Teters, Rule, Shepard and Karr voted yes; Richardson
absent.
The business license application was approved subject to
the payment of the fee.
A Hearing was had regarding the vacation of Lots in Indian
Hills Subdivision. All necessary publications were made. Mr.
Skinner, attorney, representing Jim Davis who had requested the
hearing were present. Also present were Chuck McKeon and Grace
Kemerling, residents of Indian Hills. The reason for the
vacation of the lots is they were platted prior to the present
subdivision plat made by Jim Davis and since it appeared they
were not vacated when Jim Davis platted his new addition, this
had to be done at this time. There were no protests to the
vacation of the lots.
Karr moved that Bill No. 90-64 be placed on its first
reading, said Bill provides for the vacation of certain lots in
Indian Hills SubDivision as more fully set out in the Public
Notice. which is attached hereto and made a part hereof,
seconded by Rule, the vote was Teters, Karr, Marshall, Shepard
and Rule voted aye; Richardson absent.

Karr moved that Bill No. 90-64 be placed on its second
reading, seconded by Marshall, the vote was Teters, Karr,
Marshall, Shepard and Rule voted aye; Richardson absent.
Whereupon, the Bill having been made available for public
inspection prior to consideration by the Board of Aldermen,
Bill No. 90-64 was passed.
A hearing was had on the vacation of Houston Street. It
appeared all the proper notices were published. The reason for
the vacation of this street is the fact that it was platted and
never made a public street. Now the plat has been changed and
the Houston Street would serve no purpose. Grace Kemerling was
present. There were no protests.
Karr moved that Bill No. 90-65 be placed on its first
reading, said Bill provides for the vacation of Houston Street,
seconded by Rule, the vote was Shepard, Teters, Rule, Karr and
Marshall voted aye; Richardson absent.
Rule moved that Bill No. 90-65 be placed on its second
reading, seconded by Marshall, the vote was Shepard, Teters,
Rule, Karr, and Marshall voted aye; Richardson, absent.
Whereupon, the Bill having been made available for public
inspection prior to consideration by the Board of Aldermen,
Bill No. 90-64 was passed.
A letter was received from Missouri Public Service
regarding Missouri Cities Water Company applying for an
increase in their water rates.
Mayor Burch said she met with the Mayors of the
surrounding cities and Lake Waukomis, Houston, Parkville, Water
District No. 6 and Platte Woods are interested in protesting
this increase application and would be interested in employing
Jeremiah Finnigan to represent their cities. Mayor Burch said
at previous hearings, the attorney representing the Cities was
paid on a prorata basis, determined by the amount of water
meters in the City and this was agreeable to the Aldermen.
Teters moved that the City of Riverside, Missouri join
with the other Cities to protest the Application of Missouri
Cities Water Company for an increase in rate and employ
Jeremiah Finnigan, Karr seconded the motion the votes was
Shepard, Karr, Rule, Marshall and Teters voted yes, Richardson
absent.

A hearing was had on the location of Drug and Alcohol
Rehabilitation Centers. The Planning Commission recommended
that it be east of Mattox Road and South of DeConich Road.
Marshall moved that the City accept the recommendation of
the Planning Commission and moved that Bill No. 90-66 be placed
on its first reading, said bill provides for the location of
the Drug and Alcohol Rehabilitation Centers in the City of
Riverside, Missouri be east of Mattox Road and South of
DeConich Road, seconded by Rule, the vote was Karr, Rule,
Shepard, Teters and Marshall voted aye, Richardson absent.
Marshall moved that Bill No. 90-66 be placed on its second
reading, seconded by Shepard, the vote was, Karr, Rule,
Shepard, Teters and Marshall voted aye; Richardson absent.
Whereupon, the Bill having been made available for public
inspection prior to consideration by the Board of Aldermen,
Bill No. 90-66 was passed.
Jim Davis talked to the Mayor and Board regarding his need
for an extension on the blasting of the area in his new
addition. He didn't know for sure that he needed the
extension. He said since there would be no meeting on January
1, 1991, he would like an extension on the Blasting Permit in
case there was need for it. He was hopeful the blasting would
be complete by December 31, 1990. It all depends on the
weather.
Teters moved that Jim Davis have an extension to January
7, 1991 on his Blasting Permit, seconded by Rule, the vote was
Karr, Teters, Rule, Shepard and Marshall voted yes, Richardson
absent.
Karr moved that Bill No. 90-67 be placed on its first
reading, said Bill enacts an Alcohol and Non-Prescribed
Controlled Drub Policy for the Employees of the City of
Riverside, Missouri, seconded by Teters, the vote was Karr,
Marshall, Teters, Shepard and Rule voted aye; Richardson
absent.
Karr moved that Bill No. 90-67 be placed on its second
reading, seconded by Marshall, the vote was Karr, Marshall,
Teters, Shepard and Rule voted aye; Richardson absent.
Whereupon, the Bill having been made available for public
inspection prior to consideration by the Board of Aldermen,
Bill No. 90-67 was passed.

A discussion was had regarding the purchase of an extended
warranty on the new police vehicle.
Marshall moved that the City Purchase an extended warranty
on the new Public Safety vehicle, seconded by Rule, the vote
was Karr, Teters, Rule, Marshall and Shepard, yes; Richardson
absent.
Mayor Burch said the next phase in the sewer construction
would be to get the easements and the cost of each easement
would be approximately $125.00. Mayor Burch said she met with
City Attorney Don Witt and E. T. Archer for the proper and
appropriate easements to be secured and she needs authority to
proceed with this direction.
Karr moved that the Mayor proceed with the securing of the
proper form for securing easements regarding the construction
of the sewer, seconded by Rule, the vote was, Karr, Teters,
Marshall, Shepard and Rule yes; Richardson absent.
The Stewart Property was discussed. It was decided that
they do have a building permit to complete the remodeling of
the building.
A recess was called. Meeting reconvened. The roll was
called and Marshall, Teters, Karr, Shepard and Rule were
present, Richardson absent; and Mayor Burch presided over the
remainder of the meeting.
Karr moved that the meeting go into executive session to
discuss personnel matters, seconded by Marshall, the vote was
Karr, Rule, Marshall, Shepard and Teters yes; Richardson
absent.
Karr moved that the meeting go into regular session,
seconded by Marshall, the vote was Karr, Rule, Marshall,
Shepard and Teters yes, Richardson absent.
Shepard moved that Bill No. 90-68 be placed on its first
reading, said Bill provides for the employment of Robert
William Bayless, Jr. as Director of the Public Safety
Department for the City of Riverside, Missouri as of January 8,
1991 at the salary of $39,000 per annum, seconded by Marshall,
the vote was Karr, Shepard, Teters, Rule and Marshall voted
aye; Richardson absent.
Karr moved that Bill No. 90-68 be placed n its second
reading, seconded by Teters, the vote was: Karr, Shepard,

Whereupon, the Bill having been made available for public
inspection prior to consideration by the Board of Aldermen,
Bill No. 90-68 was passed.
Karr moved that Bill No. 90-69 be placed on its first
reading, said Bill provides for procedure for the vacation and
the mandatory repair and maintenance of buildings or structures
within the corporate limits of the City of Riverside „ seconded
by Marshall, the vote was Teters, Karr, Marshall, Shepard, and
Rule voted aye; Richardson absent.
Shepard moved that Bill No. 90-69 be placed on its second
reading, seconded by Karr, the vote was Teters, Karr, Marshall,
Shepard and Rule voted aye; Richardson absent. Whereupon, the
Bill having been made available for public inspection prior to
consideration by the Board of Aldermen, Bill No. 90-69 was
passed.
Shepard moved that bill No. 90-70 be placed on its first
reading, said Bill provides for the repealing of Section 14.17
of the Riverside Code and Repealing Section 1 of 14.18 of the
Riverside City Code and enacting two new section in lieu
thereof (pertaining to correction of nuisances), seconded by
Marshall, the vote was Karr, Shepard, Rule, Teters and Marshall
aye; Richardson absent.
Karr moved that bill No. 90-70 be placed on its second
reading, seconded by Shepard, the vote was Karr, Shepard, Rule,
Teters, and Marshall aye; Richardson absent. Whereupon, the
Bill having been made available for public inspection prior to
consideration by the Board of Aldermen, Bill No. 90-70 was
passed.
Mayor Burch will have the nuisance at Woodbridge checked
into and she said Fred Wilkin will be monitoring Green's
Trailer Court.
Marshall moved that Bill No. 90-71 be placed on its first
reading, said Bill provides for the Finance Committee to secure
bids on $100,000, seconded by Karr, the vote was Karr, Shepard,
Teters, Marshall and Rule voted aye; Richardson absent.
Shepard moved that Bill No. 90-71 be placed on its second
reading, seconded by Karr, the vote was Karr, Shepard, Teters,
Marshall and Rule voted aye; Richardson absent. Whereupon, the
Bill having been made available for public inspection prior to
consideration by the Board of Aldermen, Bill No. 90-71 was
passed.

Karr moved that Bill No. 90-72 be placed on its first
reading, seconded by Shepard, said Bill provided for the
appropriation of money out of the General Fund of the City of
Riverside, Missouri for the payment of certain indebtedness as
listed therein be placed on its first reading, the vote was
Shepard, Rule, Teters, Marshall and Karr aye; Richardson
absent.
Shepard moved that Bill No. 90-72 be placed on its second
reading, seconded by Marshall, the vote was Shepard, Rule,
Teters, Marshall and Karr voted aye; Richardson absent.
Whereupon, the Bill having been made available for public
inspection prior to consideration by the board of Aldermen,
Bill No. 90-71 was passed.
The Budget for five months was discussed.
The minutes of December 4, 1990, were read and approved as
corrected.
Marshall inquired if anyone had noticed the smell of gas
at the area around McCall's Service Station. This is to be
checked into.
There being no further business to come before the Board,
upon motion duly made, seconded and passed, meeting adjourned
at 11:45 p.m.
