AN ORDINANCE AMENDING CITY CODE SECTION 610.040 RELATING TO THE RULES
AND REGULATIONS GOVERNING THE LICENSING AND OPERATION OF ROLLER
SKATING RINKS WITHIN THE CITY
WHEREAS, Section 610.040 of the City Code currently establishes the maximum
occupancy of a roller skating rink to be 500 persons; and
WHEREAS, the fire code adopted by the City also provides regulations for maximum
occupancy of various classifications of structures within the City; and
WHEREAS, the current licensing regulations adopted by the City prohibit the service
and/or consumption alcoholic beverages on the premises by persons over the age of 21 on the
premises; and
WHEREAS, the Board of Aldermen find it is in the best interests of the City to amend the
City Code rules and regulations relating to roller skating rinks within the City as provided herein;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF RIVERSIDE, MISSOURI, AS FOLLOWS:
SECTION 1 -AMENDMENT OF SECTION 610.040 OF THE CITY CODE. Title VI,
Chapter 600, Section 610.040 of the Riverside City Code is hereby amended to read as follows:
SECTION 610.040: ROLLER SKATING RINKS
A. All persons, corporations or other legal entities owning or operating a business
establishment which includes a roller skating rink shall comply in all respects with the
following regulations enacted pursuant to the Police power of the City of Riverside,
Missouri.
1. The business establishment shall have a maximum occupancy as set forth in the fire
code adopted by the city, as amended from time to time.
2. The person, corporation or other legal entity owning or operating the business
establishment shall not allow any controlled substances or alcoholic beverages to be
bought or sold on the premises or brought onto the premises by patrons, customers,
or other individuals entering the premises; provided that, nothing contained herein
shall prohibit the sale of alcoholic beverages to persons over the age of 21 during
any special event for which the owner has been issued a liquor license, nor shall it
prohibit the consumption of alcoholic beverages at private parties not open to the
public and at which (1) alcohol is not sold, (2) the persons consuming such alcohol
are over the age of 21 and (3) the majority of persons attending such event are over
the age of 21.
3. The person, corporation or other legal entity owning or operating the business
establishment shall act to maintain order and prevent loitering in the parking areas
located on said premises and shall prevent individuals from remaining in said parking
areas for an unreasonable time after the closing time each night.

4. The person, corporation or other legal entity owning or operating the business
establishment shall maintain appropriate access to insure that emergency vehicles
can have full and complete access to any and all buildings located on said premises.
5. The person, corporation or other legal entity owning or operating the business
establishment shall operate the business in such manner as to prevent any common
law nuisance to other residents of the City including, but not limited to, nuisance
created by noise, criminal activity or indecent exposure on or about the premises.
B. The Director of Public Safety shall be charged with the duty and authority to enforce the
provisions of this Section and to report any violations thereof.
SECTION 2 -REPEAL OF ORDINANCES IN CONFLICT. All ordinances or parts of
ordinances in conflict with this ordinance are hereby repealed.
SECTION 3 - SEVERABILITY CLAUSE. The provisions of this ordinance are severable
and if any provision hereof is declared invalid, unconstitutional or unenforceable, such
determination shall not affect the validity of the remainder of this ordinance.
SECTION 4 -EFFECTIVE DATE. This ordinance shall be in full force and effect from
and after the date of its passage and approval.

RE: Roller Skating Rink Licensing Rules and Regulations
BACKGROUND: At the last meeting of the Board of Aldermen the proposed ordinance was amended
to delete any provision which would allow alcohol on the premises. The owner of the
rink, Skip Clinton, has been requested to attend the next regular meeting and address
the concerns of the Board of Aldermen relating to occupancy limits.
A copy of the existing City Code provisions are attached for your reference.
RECOMMENDATION: Staff does not have a recommendation.
BUDGETARY IMPACT: None.
