AN ORDINANCE AMENDING SECTION 210.260 OF' THE CITY CODE,
"FIRER'ORIiS" TO INCORPORATE CERTAIN PROVISIONS OF STATE
LAW.
WHEREAS, the City of Riverside. Missouri ("City"1 allows for the use and discharge of
certain fireworks under certain cirettmstances;
WHEREAS, the state. ratutes and reguiations governing the use and discharge of fireworks
have been revised; and
WHEREAS, the City desires to incorporate certain provisions of state law governing the use
and discharge of fireworks;
NOW, THEREFORE, BE IT ORDAINED by the Board of Aldermen of Riverside,

Section 1. Section 210.?60 of the City Code is hereby amended to read as follows:
SECTION 210.260: FIREWORKS
n. Dejinitinns. As used in this Section the following words shall have the meanings sat out below:
CITY: The Ciry of Riverside, Missouri-
FIREWORKS: Any substances, articles, or objecu which aze now nr may hereafter be classified as
"corrunnn fireworks" by the Ltterstate Cumrnerce Camtrtission and are labeled with the In[erstate,
Commerce Commission Class C label.
$, It shall be unla•,vfttl fcr any person to use or discharge any bottle rockets within any part of the City;
provided, that any person possesvng a valid whalesale fireworks license issued by the City may, after
giving notice to and obtaining the written approval of the Riverside Director of Public Safety,
discharge bottler rockers for [esting purposes only, and notwithstanding any provisions in this Section
to the conRaty.
C. It shall be unlawful for aoy person to ignite or discharge any fireworks within any of the fallowing
azeas in the City:
Within one hundred twenty-five (125) feet of any building cr structure.
2. Within six hundred (600) feet ofany church, hospital, asylum, or pablic school, or within one
hundred (100) feet of a permanent structure where fireworks are stored, sold, or offered for
sale.
3. Within or throw the same from a motor vehicle, orplace or throw the same into or at a motor
vehicle, ut at or near any pr,rso^ or group of people.
4. Within thrc~ hundrod (300) fee[ of any gasoline pump, gasolina filling Station, of any
nonpetmancnt structure whcrc rreworks are stored, sold or offered far sale.
D. So long as licensees fully comply with 5rctions 320.106 through 320.161 R.S.Mo. governing
fireworks, nothing in Section 210.260.e shall be construed to prevent persons with licenses issued
pursuant to $ectior. 605.30 from demonstrating or testing Fireworks provided that any such
demonstration or test shall require the notification and the written approval of the Department of
Public Safety.
E. It shall be unlawful for any person to use or discharge any Fireworks at the following tirnes~
1. On or before Tune nineteenth (14`°l and on or after ?uly sixth (6`") of each year;
2. On ar before December nineteenth (19th) and on or after January third (3rd) of enuh year;
3. After the hour of 1:00 A.M. on January f rst (1st), after the hour of 12:00 P.)v1. on July third
(3'a} and fourth (4e'j or before the hour of 10:00 A.iV1. on January first (1st), or July third
(3rd1 and fourth 4th); or
A. After the hear of 10:00 P.M. or before the hour of 10'00 A.h1. of any other permi[[nd day
F. Any person who violates any provision of this Section shalh upon conviction thereof, be fined a sum
of nut ]css than fifty dollars (550.00) nor more than fivt hundred dollars ($500.00), or by
imprisonment in the City Jai] for a term not exceeding ninety (90) days, or by both such fine and such
imprisonment. Each instance ofunlawfuluseordischargeshallconstituteaseparateoffenseandshail
be punishable as such hereunder.
Section 2. This Ordinance shall take effect immediately.
