AN ORDINANCE AUTHORIZING AND APPROVING THE ACQUISITION OF
CERTAIN LANDS AND ALL ASSOCIATED APPURTENANCES AND
IMPROVEMENTS BY EXERCISE OF THE C[TY'S POWER OF EMINENT
DOMAIN IN THE EVENT THE CITY IS UNABLE TO ACQUIRE THE PROPERTY
BY PURCHASE AND APPROVING ACTIONS AND DOCUMENTS RELATED
THERETO.
WHEREAS, the City is authorized, pursuant to the Real Property Tax Increment Allocation
Redevelopment Act, RSMo Section 99.800 et seq, and the L-385 Levee Redevelopment Plan, as
amended ("Redevelopment Plan"), to acquire property to achieve the objectives of the Redevelopment
Plan; and
WHEREAS, the City desires to so acquire the real property described at Exhibit A (the
"Property")which Property is located within the Redevelopment Area (as defined in the Redevelopment
Plan);
BE IT ORDAINED BY THE BOARD OF ALDERMAN OF THE CITY OF RIVERSIDE,
MISSOURI, AS FOLLOWS:
Section 1. This Ordinance and the acquisition of the Property is intended and is hereby
determined and declared to be necessary to accomplish, serve and achieve the objectives of the
Redevelopment Plan.
Section 2. The City made an offer to acquire all interests, including fee ownership, in the
Property by negotiation and the offer was rejected.
Section 3. It is hereby deemed that the City has been unable to acquire the Property through
good faith negotiations. The acquisition of the Property through the City's power of eminent domain
is authorized and approved pursuant to the authority vested in the City by and under the Constitutions,
laws, ordinances, rules and regulations of the City, the State of Missouri and of the United States of
America.
Section 4. The Mayor, the City Administrator, the City Attorney and other appropriate City
officials are authorized to take any and all actions as may be deemed necessary or desirable to carry out
and comply with the intent of this Ordinance and to execute and deliver for and on behalf of the City
the offer, a petition for condemnation, all certificates, instruments, agreements and other documents, as
may be necessary or desirable to effectuate the intent of this Ordinance.
Section 5. This Ordinance shall be in full force and effect from and after its passage and
approval.
