HomeMy WebLinkAbout1999 - 70 - Amendments to Chapter 605 of the Municipal CodeBILL NO. ~ `J ~ "~~- ORDINANCE NO. 99~D AN ORDINANCE AMENDING TITLE VII, CHAPTER 605, ARTICLE I, SECTIONS 605.010, 605.060 AND 605.070 OF THE RIVERSIDE MUNICIPAL CODE TO PROVIDE CLARIFICATION THEREOF AND TO REQUIRE ALL APPLICANTS FOR BUSINESS LICENSES TO BE IN COMPLIANCE WITH ALL CITY ORDINANCES AND STATE LAWS AND REGULATIONS AND EACH LICENSEE TO USE RIVERSIDE, MISSOURI AS ITS BUSINESS ADDRESS FOR ALL LOCATIONS WITHIN THE CITY. WHEREAS, it is in the best interest of the health, welfare and safety of the citizens of the City of Riverside ("City") that businesses comply with City ordinances and Missouri laws and regulations; WHEREAS, the attribution of Riverside licensees to the City, affecting among other items, the collection of tax revenues and state and federal grants and other participation payments, is in the best interest of the health, welfare and safety of the citizens of the City; BE IT ORDAINED BY THE BOARD OF ALDERMEN FOR THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS: SECTION 1. The Riverside Municipal Code, Title VI, Chapter 605, Article I, Section 605.010 is hereby repealed and a new Title VI, Chapter 605, Article I, Section 605.010 enacted as follows: SECTION 605.010: LICENSE --- REQUIREMENTS--- SCOPE. A. No person shall carry on or operate, maintain or engage in any occupation, business, trade or avocation of any kind enumerated herein without first obtaining a license which said license shall be issued by the City Clerk or his/her representative to such person, firm, partnership, corporation or legal entity upon proper application being made therefor to the City Clerk or his/her representative; compliance with all City ordinances and State laws and regulations, including but not limited to the payment of all personal property taxes, earning taxes and permit, license and certificate fees; certification of such compliance to the City Clerk or his/her representative; and payment of the fee prescribed by the Board of Aldermen, except that no license shall be required under this Chapter from: Any farmer or producer(s) selling produce which was raised by such farmer or producer(s) when sold from such farmer or producer(s) wagon, cart or vehicle or from any person(s) in the employ of such farmer or producer(s); or 2. Any other person who is excepted by Missouri law from the imposition of such license requirement. B. No license shall be transferable or assignable. C. Each license that is issued to a designated address or location shall not be used for any other location within the City of Riverside unless application for a different designated address shall first have been made to the City Clerk or his/her representative and permission granted by the City Clerk or his/her representative. F,ach and every licensee carrying on or operating, maintaining or engaging in any occupation, business, trade or avocation of any kind enumerated herein at any location within the City of Riverside shall, when referring in any manner to the address of such location, use "Riverside, Missouri" or an abbreviation thereof as the city/state in such address. SECTION 2. The Riverside Municipal Code, Title VI, Chapter 605, Article I, Section 605.060 is hereby repealed and a new Title VI, Chapter 605, Article I, Section 605.060 enacted as follows: SECTION 605.060: ISSUANCE AND FORM OF LICENSE "The City Clerk shall issue all licenses prescribed in this Chapter and shall prescribe the form therefor. SECTION 3. The Riverside Municipal Code, Title VI, Chapter 605, Article I, Section 605.070 is hereby repealed and a new Title VI, Chapter 605, Article I, Section 605.Oi0 enacted as follows: SECTION 605.070: COMPLIANCE WITH LAWS AND ORDINANCES The City Clerk shall issue all licenses subject to the licensee's compliance with all City ordinances and State laws and regulations, including but not limited to the payment of all personal property taxes, earning taxes and permit, license and certificate fees and all zoning requirements, and shall have the power to revoke any license for failure to comply with any of such requirements and upon application may refund the unused portions of the annual license fee paid for such revoked license. SECTION 4.
