HomeMy WebLinkAbout1999 - 91 - Amendment to Section 405.070 of the Municipal CodeORDINANCE NO. q~1-91 AN ORDINANCE AMENDING THE RIVERSIDE ZONING CODE, CHAPTER 405, ARTICLE II, SECTION 405.070, DEFINITIONS, REGULATING THE DEFINITIONS OF TERMS WITHIN TITLE IV OF THE CITY CODE OF THE CITY OF RIVERSIDE, MISSOURI. WHEREAS, the Board of Alderman desires to amend the City's sign regulations applicable to Billboards and non-Billboard signs within the City to prevent visual clutter while protecting free speech under the First Amendment; WHEREAS, the Board of Alderman desires the definitions in Section 405.070 to coincide with the definitions found in the proposed Chapter 430, Sign Regulations; WHEREAS, the Board ofAlderman desires to add those specific terms and definitions listed below that are not currently found in Sections 405.070 terms found below; WHEREAS, the Board desires to repeal the current terms and definitions found in Section 405.070 that are inconsistent with those terms and definitions listed; IT IS HEREBY DECLARED that the definitions found Section 405.070 shall reflect the teens found in Chapter 430 governing Sign Regulations within the City; BE IT ORDAINED BY THE BOARD OF ALDERMEN FOR THE CITY OF RIVERSIDE, MISSOURI AS FOLLOWS: SECTION 1. The Riverside Zoning Code, Chapter 405, Section 405.070, is hereby amended as follows: ARTICLE II. DEFINITIONS SECTION 405.070: DEFINITIONS For the purposes of this Zoning Code, the following words and terms as used herein are defined to mean the following: one FOOTCANDLE: A standard unit when measuring the surtaceArea' PoWa' quantity of light; one footcandle shall equal the total intensity ' Foa' of light that falls upon a surface that is one square foot in area and is one foot away from a point source of light with the ="~ ~~ D~sGn<e i- 1 Foot From Candle._ intensity of one candela or one candle. FREE STANDING SIGN: A sign which is supported by one (1) or more structures or supports including uprights, poles, or braces, that are placed on, or anchored in, the ground and that are independent from any building or other structure. GROUND SIGN: A sign made of brick, masonry, stone, or wood and the bottom of which is attached directly and permanently to the ground and physically separated from any other structure. Any sign attached to a pole, shaft, post, stick or beam shall be considered a "Free Standing Sign." LOT: A tract, plot, or portion of a subdivision, or other parcel of land occupied by, or intended for, occupancy by one (1) principal building or structure and having access to a public street. SIGNAREA: The area of the Sign Facing. The "sign-area"of amulti-faced sign is the sum of the sign areas of each face, including structural trim which can be seen from a single location on any adjacent street and which displays, or upon which is displayed, any graphic, message, name or symbol of any kind for the purpose of advertising, announcing, directing or attracting attention from the outside of the building. If a sign, or letters, are attached to a building or suspended in any manner whereby there is no apparent trim or confining border, the sign area shall be computed by drawing imaginary straight lines around generally rectangular margins and measuring the area so encompassed by these lines. The term and definition of TEMPORARY SIGNS is hereby deleted. SECTION 2. The terms, definitions, clauses, and phrases of this Section are severable, and if any phrase, clause, sentence, or paragraph, of this Section shall be declared unlawful by a valid judgement, decree, or injunction order of a court of competent jurisdiction, such ruling shall not affect any of the remaining phrases, clauses, sentences, or paragraphs of this Chapter. In the event that, contrary to the policies, interests, and values of the City, a court of competent jurisdiction issues a judgement, decree, or injunction order that this Section is unlawful because of any omission or prohibition in this Section, than all provisions of this Chapter not specifically declared to be unlawful shall remain in full force and effect. In the event that a judgement, decree or injunction order declaring all or a portion of this Section to be unlawful is reversed or vacated by a court of competent jurisdiction, the provisions contained in this Section shall remain in full force and effect. SECTION 3. This Ordinance shall be in full force and effect from and after its passage and approval.
